Any lawyers here? Need advice on parking ticket.

My friend parked by the curb, and received a ticket for violating the municiple code, no parking between 2-4AM. There are absolutely no signs or indicators stating this regulation. How can he be charged if there was no way he could've known?

No parking in your driveway between 2-4am..? What are you supposed to do..leave every night? 😕

Note the edit to now read "sidewalk" instead of "driveway"

You park on the sidewalk and don't expect to get a ticket??

It's late.. you know what I mean.. stop nitpicking at my english. 🙁
Gosh you guys are quick. I realized that like 20 seconds after I edited it.

Request affidavit, send a picture of the street and a well-written note saying that you were indeed parked there, but that there was no sign and you didn't know about the code. Ask for a reduction in the fine, get it, pay it.

No ******, but it goes against logic to do that and is clearly unreasonable.

Most cities have parking ban from certain times...

It has nothing to do with logic.

Should the city's welcoming committee come by your house when you move in and school you on all the ordinances for your city?

The responiblity is yours...

Yes it does have to do with logic. It's illogical to expect a person to have to go to read the city's 500page lawbook when they decide to visit another city? That's beyond ludicrous.
The responsibility is with the city to post signs to inform people.
That's like if a city decided to ban right turns on reds and didn't post any indicators of the ordinance. People would be getting charged left and right. Logical? My ass.

It's not against logic. The logic they're using is geared towards revenue maximization. Signs warning you would cost them money. This way, they can ticket people and collect revenue with impunity. Sure it sucks, but 85% of city ordiences or so are just as pointless and either geared towards revenue generation via fines or came about due to some personal grudge a counciler had way back when.

Overnight Parking
The Walnut City Code prohibits overnight parking on all City streets between the hours of 2:00 a.m. and 4:00 a.m.

The Overnight Parking Ordinance is primarily for residents' safety. Fewer vehicles on the street at night make it easier for Sheriff's Deputies to observe suspicious vehicles and activity, thereby increasing safety during night-time hours. The Sheriff's Department and Fire Department can more readily locate curb addresses and reduce emergency response time when the street is clear of parked vehicles. In addition, Walnut's streets are kept free of abandoned and inoperable vehicles.

If Walnut residents are having overnight guests and there is no available space in their driveway or garage, they may obtain a free temporary parking permit for a period of five days. Applicants of temporary permits should submit the license plate number of the vehicle that is to be parked on the street overnight.

Permanent parking permits may be obtained for six months in January and July for $26. Annual permits may also be obtained for $52 and should be purchased in July. The annual permits are good for the entire fiscal year, from July 1 through June 30 the next year. Parking permits are available at the Walnut City Hall during business hours and at the Walnut Sheriff's Station, 21695 East Valley Boulevard, when the City Hall is closed.

For additional information on overnight parking permits, call the Walnut City Hall at (909) 595-7543.

Wow what a PITA... is this just another source of revenue?

I don't remember the last time I saw a "No Murdering" sign, but I'm fairly sure that's illegal too. It's your reponsibility to know the laws, ignorance does not give you immunity.

my town does that too, along with almost every other town around here that I can think of, except one.

Oh please, those are two completely different things. No murdering is common sense, that any sane person would know, no parking between 2-4AM is something no one would know if they were not somehow notified.

But then again, I'd be crazy to expect ATOT to not try to contradict the OP.

They are both laws. Unfortunately for your friend, even if you don't know the law, you are still bound by it. the reason ATOT is contradicting you is because you are wrong. If you post something that is true, then ATOT will not contradict you. Or at least only people who are wrong will contradict you.

And just to humor you here...what the hell would a lawyer do for you? Sue the town for having a law? Sue the people for electing the town council that voted in that law? Sue the police for enforcing the law?

What could we (ATOT) do to make you happy? Empathize? Hold your hand while you lose in court?

Um a lawyer would know the system enough to know how I can get my friend out of the ticket?
What could ATOT do(or not do). I don't believe any sane person is thick enough to believe that one should read the city's ordinances every time one enters a city. Unless you're really insane and believe that, you are just playing devil's advocate. Don't bullshit me.
