im sure most of you know the trouble im in..

but anyway.... i was charged with posession of a controlled substance... while in jail waiting for my bond to be posted by my wife, i requested a court appointed attorney..

later, when i got out, after 14 days, i received a letter in the mail stating i had been appointed an attorney...

then, today i received another letter saying the previous letter was incorrect, and that i had NOT been appointed an attorney..

so i called the county clerk and she told me that unless your disabled i could not be appointed an attorney, regardless of income, regardless that i was in jail unable to post bond for two weeks, regardless that i dont make enough to pay for the 5000 dollar retainer fee lawyers want to represent me...

i just think this is ridiculous...SO UNLESS your disabled you dont have right to legal counsel?

that's BS, because during the announcement the judge appointed the guy next to me an attorney, a thug looking guy dressed in typical street thug clothes IN THE COURTROOM based on unability to afford one.

A lawyer is worthless on a drug charge unless you think he can get it dropped. Just act like you are going to trial, and the deals get better and better the closer you get to the trial.

the right to an attorney is interpreted differently in each state. Looks like your state takes a harder line...If you own a car, or own a house, you can afford an attorney...I've seen judges tell defendants to sell their car or refinance their homes to pay for an attorney, and deny their request for a court appointed attorney (and state/county paid for attorney). Life sucks...but you decided to posses drugs...so deal with your decision...

no i was in the process of working out a deal with the county prosecutor, when they decided to do a bond enhancement, came and picked me up and made me fork over the money for the bond enhancement...which was doubled from 2500 to 5000

So if someone gets a felony reduced to a misdemeanor he/she is still worthless?

BTW, there are no guarantees when you go to trial/court.

Nope, has nothing to do with disability, it has to do with ability to pay. However, the law likely defines *ability* to pay differenly than you.

Here's the Texas law but you'll need to find out the specifics of what qualifies a person at indigent.

Just google, and/or go down to the Clerk's Court (or what ever it's called in your are) for more info.

BTW: I saw something that seemed to indicate that if you are found guilty etc, you're gonna be charged for the lawyer no matter what anyway.
