I was wondering if there are any Lawyers that post on this board. I have a "friend" who got into some trouble (which I wont get into detail) about a year ago and the court has been postponing the court date at least 6 times, I was just curious if they are allowed to do this, and how would I go about getting this case dismissed.

Thanks

DevilsAdvocate is a laywer.. or was a lawyer. I don't know, but I do know that countless amount of under-qualified ATOT users would love to offer their (in all regards, useless) opinion.

1. Call a lawyer in your area. Every state has differing rules and regulations pertaining to trials.
2. How do you expect anyone to give advice on a dismissal when you havent provided any evidence as to why it should be dismissed?

Raises hand. 😀

one of your constitutionally guaranteed rights is to a speedy trial, however the constitution never specifies how fast that has to be, so each state generally has laws about how quickly it has to occur. if i recall correctly, its usually around 60 or 90 days.

reporting for duty!

.... but I did stay at a Holliday Inn last night! 😉

It probably depends on the type of case, the type of court, and the state you're in. Most likely the case/trial can continue to be postponed until the judge decides he's sick of it and wants it off the docket.

You have a constitutional right to a speedy trail. You can press that issue.

id imagine the judge can postpone as long as he wants, as long as the reasons are valid in they eyes of the law.
