It is against Ebay policy for him to do that.
You can report him to Ebay HERE .

they will invesigate and if you are proven right, they will end his auction, and give him a warning. But you dont want to leave it too long or the auction will end on it's own and he will get away with it.

You can also to to the main Ebay page and on the right side of the page, there is a link to LIVE HELP where you can 'chat' to someone at Ebay about it.

🙂

ok... now he's in trouble.
It would have been ok with me if he fired off an email first to let me know.

bah ebay wont do crap in time and you just wated your time. I've had people tell me that before and i told em to go ahead and file the thing. Ebay's response time is about a week, so by the time they decide to do anything, it wont matter.

why does that crap bother you so much? its got no effect on you what so ever even if he is using your picture, you've already invested the effort to take it and him using it wont change anything. ...Geez some people are so uptight and anal about stupid #@#@

where is it against the policy? That link is for reporting items that are illegal on ebay (guns etc), not for "stolen" descriptions.

iPIX user agreement says that you're giving up your copyright to them if you use their service and theres no way you can claim the description when you ripped it off the creative website.

The only real problem is the fact that he used your original picture instead of taking his own. That's false advertising. It would be obvious that it's not the actual item he is showing if he took a picture off of a manufacturer's or retailer's site.

1) Report a listing violation or prohibited item....
2) Copying your listing
3)Your description listing was copied, Your picture was copied, Your listing title was copied, Someone is linking to your pictures without permission, Someone copied text or pictures from another website or Ebay user.

🙂

In which case the OP is in violation for copying the text from Creative.
It's okay if you put, "Description taken from <this website>" somewhere in the auction. As I can't view the auction I have no way of telling whether or not he did that.

I did put a link of Creative Labs website for the item. Although some of the description are there, I have to manually type in whatever is listed on the box which is NOT on the website. Plus take some time making the description look professional.
Another thing, as any ebayer seller would know, taking a photo of a shrink wrapped box would create a flash back from the wrapping creating a not so good photo. My efforts was just simply recreated by a simple copy and paste. Thats what I got pissed.

uhh you just tilt it to the side, so the flash doesnt come back at you,
its funny that you're arguing about how much effort you put into it and the other guy just copied it and at the same time you're wasting even more time posting about it here and reporting it to ebay and what not else. You're not gonna accomplish anything...

That's not so bad. Some time ago a seller used some of the my charts from a video card review I had done in his posting, but since he included a link to the review, I didn't get too bent out of shape. Heck, it might have even led to a few more folks reading it that might have not seen it otherwise.

you suck at the picture taking.

Thats the only "good" picture that came out, i took almost 20 shots with my cheapo & freebee 2.1MP camera. I also took it at night, the only time I could get around after working and taking care of the family.

same time you're wasting even more time posting about it here and reporting it to ebay and what not else. You're not gonna accomplish anything...

well, if ebay does something, just even a notice to him, it would teach him that copying other work is not acceptable, he needs to make an effort too!!! It makes me think if all his other listings were also copied.

Incidentally, just posting something on the internet automatically carrys a copyright these days. That dude is violating your copyright, you should threaten legal action and watch him crap his pants!

Oh yeah, and don't quote this post or I'll sue you 😉
