So I paid for a whole bunch of items from the same seller on March 1st. I got all of them but one. The seller claims he is going to send another one, and I continually email him every week and he keeps saying he will email it out this week. If I am right, you only have 45 days to file a dispute, and thats coming up. Should I wait until a day from the deadline and file a dispute just to cover my ass? If the record shows up then can I cancel my dispute? How should I work this?

Since the seller is at least responding to you, warn him/her that since the issue reamains unresolved after all this time has passed, that on a certain date you will file a dispute to protect your rights. If you dont receive the item by a certain date regardless of all the sellers false promises in the past, you will file. The end.

It gives the seller one last chance to make it right and you the opportunity to be potentially made whole.

Is it 45 or 30 days to dispute. Personally, I would avoid disputing this because you bought multiple items under one purchase. Paypal will probably screw this up and cause you a world of hurt.

Question: What is the value of the single item that you have not recieved?

I didn't buy multiple Items in one action. It was multiple auctions from 1 seller. If I don't receive it will only be out $6, but it's the principal of it, and I don't want to just give someone $6 for being a shitty seller.

Anways I have consistantly been messaging the seller and they always claim to "send it out this week". If he sends it this week, and I wait to get it, it will be too late to file a claim.

Are you serious? A month later and this seller still hasn't got his act together?

Report his sorry ass to eBay, Paypal, his mother-in-law and anyone else involved.

What the heck are you thinking? "Gee whiz, I'll let this seller screw me rather than offend him by complaining that he's a month late"?

Just leave him bad feedback and eat the $6. Your best case scenario versus eating the $6 are not that far apart.

Nope, never had a tracking number on the first shipment either.

If I report the person, and I end up getting the item can I retract my case?

That's a dumb suggestion. Why should he eat the $6 at all? Granted, it's not a lot of money, but if he has the option to file a paypal claim for an undelivered item, then he should do it.

Since the emails have not helped, open a resolution ticket through paypal. The first step is just communicating with the seller, but through paypal rather than email or ebay messages. This allows paypal to review the communications later on. If the seller does not cooperate, open a claim for the $6 (you can specify the amount you want refunded). If the seller delivers on his item, you can always close the claim early.

I just finished with a paypal claim. The seller sent a defective item. It was only $17, but why should I be left losing any money for buying an item. In my case, the seller didn't respond to the claim and I got the $17 back.
