umm wow, SC rules on this are fucked up.

South Carolina does not have any laws requiring an employer to provide a meal period or
breaks to employees, thus the federal rule applies. SC Dept. of Labor FAQs. The federal
rule does not require an employer to provide either a meal (lunch) period or breaks.
However, if an employer chooses to do so, breaks, usually of the type lasting less than 20minutes, must be paid. Meal or lunch periods (usually 30 minutes or more) do not need to be paid, so long as the employee is free to do as they wish during the meal or lunch period. DOL: Breaks and Meal Periods.

Seriously?

At my last job, I was the only "offical" employee left. The last one that was actually employeed by the company (aside from the owner). I called out because I just spent 5 days driving to El Paso to get my sister-in-law and her baby because her husband decided he wanted to be a dick and I didn't get home until late Sunday. (I was actually on christmas vacation the prior week).

He then sent out a memo the following day to everybody that worked for the company, including contractors (remember, I'm the only actual employee at this point) stating that the new rule for employees regarding time was to work from 8a-5p with a 30 minute lunch. This is two weeks after he slashes my pay and a few weeks after he converts the next-to-last employee to a contractor.

because this is a substantive change in working conditions it can be seen as being fired and you can collect un-employment while looking for another job.

My friend that works doing in CAD at AMD gets all sorts of flex time.
Lives in Texas (Austin) and gets paid well, doesn't pay sate income tax and even came from Texas.

My boss/department head is a woman. She works from 6:00AM-6:00PM, doesn't take lunch, uses the bathroom maybe twice a day and is always at her desk. Coming in late/leaving early/long lunch? Not a chance. Luckily for me, I'm punctual to a fault. Others in the office? Not so much and they always get poked in the eye for it.

But back on topic; these pre-existing rules weren't enforced b/c the break thing wasn't abused. Obviously enough people abused it for long enough for it to become a problem. Action=reaction. Simple.

This'll open a can of worms, but I've been a department head myself. I don't smoke but had smokers in my shop. 15 minutes outside every hour, plus an hour lunch equaled not much work done. I cut it down to ONE cig break before and ONE cig break after lunch. I'm not a clock watcher and enjoy a 90-minute, "1 hour" lunch myself and don't care if my employees do the same. But when I lose two hours of work out of you every day due your smoking habit, we have a problem.

More work, less talkie-talkie in the smokepit outside, OK? :sneaky:

An employee must be granted a 15 minute break for each 4 hours that will be worked.
