To be able to come to a COMPLETE stop, a few inches away from the guy, you would have almost had to hit the breaks before he even started pulling out. Most people who dart across the road accelerate pretty quickly. Lets assume that they had to travel the width of your side of the road + the lenght of their car. 25-30 feet? Starting at rest, and accelerating to 15 mph doesnt take that long, and they could probably do that easily. So.. 15mph is 22 feet per second. Divide that by two and assume for constant acceleration, and it would take him maybe 2-3 seconds to cross your lane, or your half of the road.

So what you are telling us is, that you slammed on the brakes, came to a stop from 45mph to 0, within a few inches of his car, AND he still hadn't finished passing in front of you "I STOP with just a few inches to spare as he crosses in front of me.", which should have only taken him 2-3 seconds. So if he was s till in front of you, then all of this happened in 2 seconds (you spotting him, AND stopping in time). Err... thats why I call BS on this. At the very least, you are greatly exaggerating all the details.

3) If you had slammed on the breaks, and barely hit him, you would have been at fault for going 45 mph. Since 5mph slower could have easily allowed you to stop in time. The facts speak for themselves 🙂 As long as you are admitting that you don't remember that happened (as you stated directly above), then its all good.

I already explained that if you hit the breaks as he started crossing, it would still only take him a few seconds to cross... that inclues starting from ZERO, which since you say you saw him starting, means he was slightly above ZERO.

You are still standing by the statement that you stopped and he was directly in front of you. That still means you are claming that:

1) You saw him start moving
2) You hit the breaks going ~45 mph
3) You stopped in 2 seconds or less (because he was still in front of you)

Like I said before, BS. If you change your story, then maybe I will believe you.

If there's a traffic light, there's no doubt as to who had right of way.

But the fact remains that it was just an intersection w/ no stops whatsoever, and you both your cars went through it roughly the same time. You just happened to be the one who was "nice" and let the other dude pass first.
