It's better than illegal; you're not at the mercy of somebody's poor encoding skills.

AllOfMP3 has the cleanest sounding downloads of any big service. Their Explorer app kicks butt; I can browse their entire catalog on my hard drive instead of going to their website, and they have a good number of songs. Just got a few Muse albums, and the new Switchfoot album (which kicks butt too, highly recommended). I stick to LAME 320kbps VBR, but they also have lossless formats as well.

And they're CHEAP!

I've used my CC with them without issues for the past year.

There's a lot of room for argument IMO.
The site is functionally legal, whether or not they are ethically sound is not a legal question and one only your own moral conscience can answer.
There needs to be more explicit regulation of things of this nature.. the comparison to amazon.co.uk is appropos. One can often find textbooks there that are chaper than for sale at amazon.com. Is it therefore less ethical to buy from Amazon.co.uk?
 
well the textbooks are probably under copyright law, uk has its own publishing industry and has a decent record of protecting intellectual property, so i doubt they are doing something sleazy. russia on the other hand, is the wild willd west in terms of law and business. even when there is law, enforcement is questionable.

heh put it this way. is it really that hard to just steal it if thats what you want to do? whats worse? just robbing the artist? or robbing the artist to allowing some scumbag to benifit from your crime too🙂

Your argument is full of assumption. Don't you think it's morally objectionable to ASSUME that any Russian site is stealing?

Perhaps, (and it beats the hell out of me) Russian\American law currently allows for this to occur and they are in full accordance with the law. If they are is it STILL objectionable?

A guy from work added a few dollars to allofmp3 with his credit card, about 10 minutes later his credit card company called him, they said they were calling because of suspicious activity.. a charge processed by a russian address lol
 
still worried about the risk of using cc. Just tried webcertificate. Damn they charge $3 fee for a $20 gift card.

I've had credit card companies call me up when I make purchases in Iowa and then turn around and make purchases in AZ the next day. They think my card has been stolen. I've had this happen a couple of times.

Nothing really surprising. If you just out of the blue have a charge show up from a Russian domain it's going to throw up a flag.

Russian copyright legislation allows phonograms to be performed publicly without the authorization of the copyright owner for broadcasting and cable transmission. (Article 39) The Internet could be deemed to fall under this exemption. The copyrights involved have to be paid to a collecting society.

Allofmp3 has signed agreements for this with Russian Organization for Multimedia &amp; Digital Systems (ROMS). According to license ? ??-??-02-36 the Internet-project www.allofmp3.com, has the right to use musical compositions by providing downloads. Under the license agreement Allofmp3 pays out fees to ROMS for downloaded materials that are subject to the Russian Federation Copyright And Related Rights Law.

ROMS is a member of CISAC (www.cisac.org) - the International confederation of authors and composers societies. ROMS manages intellectual rights in the Russian Federation. All third party distributors licensed by ROMS are required to pay a portion of the revenue to the ROMS. ROMS in turn, is obligated to pay most of that money (aside from small portion it needs for operating expenses) to artists. Both Russian and foreign.

We have received this confirmation from ROMS:

So, they do pay royalties on the songs according to most info I can find. They can legal distribute the music. Question is whether or not it's legal in the US to use the site. My best guess is that right now, it's legal but that may change in the future.
