Who cares if he's paying attention? Democrats (and Lindsay Grahamnesty) are going to vote for her because she's an ideologue who will advance progressive issues at the expense of the Constitution. Republicans are going to vote against her because she's an ideologue who will advance progressive issues at the expense of the Constitution. Both parties are simply interested in pursuing their own agendas. Everyone knows this. These hearings could be dispensed with entirely without affecting the results one tot. Most of each question is a statement for or against her which could just as easily be made as a floor speech when everyone is gone except for a few waiting to make their own floor speeches. When the sham no longer fools the populace there is no point to even pretending to consider her qualifications or lack thereof, just check that she meets the bare minimum (close, but she squeaks in) and hold the damned vote.
And as much as I hate the idea of the vapid and dishonest political creature being raised to the highest court for life, I can't support a filibuster either. The Senate has a Constitutional duty to vote on a president's nominees, and it needs to do its duty even when the president sends them a turd. If as now we elect senators who will polish that turd for their guy at the expense of the country, well, then we have the government we deserve.
