Not sure, but wouldn't a town in the US founded on conformance to religion and the rejection of others be a Constitutional breach ?

The town of Ave Maria is being constructed around Ave Maria University, the first Catholic university to be built in the United States in about 40 years. Both are set to open next year about 25 miles east of Naples in southwestern Florida.

The town and the university, developed in partnership with the Barron Collier Co., an agricultural and real estate business, will be set on 5,000 acres with a European-inspired town center, a massive church and what planners call the largest crucifix in the nation, at nearly 65 feet tall. Monaghan envisions 11,000 homes and 20,000 residents.

During a speech last year at a Catholic men's gathering in Boston, Monaghan said that in his community, stores will not sell pornographic magazines, pharmacies will not carry condoms or birth control pills, and cable television will have no X-rated channels.

It sounds mostly legal. If there is a law that requires a pharmacy to carry birth control and it doesn't that would not be legal. But if you own the pharmacy you can choose not to carry porno mags. If you rent a house to someone and the terms of the lease are that you are including cable tv under a contract you have with the cable company, and that the renter cannot order channels on their own nor put up sat dishes than you can choose the channels you offer.
Of course the whole idea is lunacy and Anti-American and against the words and teachings of Jesus Christ (imo) there is nothing wrong with it.
Of course if Monaghan does this I won't buy his cr*ppy pizza ever again. And that is my legal right.
EDIT: Oops. I just saw he sold off Dominoes.
So I guess I can still eat the cr*ppy pizza.
Doesn't Monaghan own some sports teams? I can boycott their games.

This guy has been doing wacky stuff for years. Near where I went to college, in Ann Arbor, MI, he's in the news all the time, everyone pretty much makes him out the be the "Bored person with too much time and money on his hands"

He bought several apartment buildings and turned them into dorms, adjacent to the Ave Maria college he started up here. He also bought an old frat house, renovated it, and turned it into sleeping quarters for all the nuns that would be the colleges' teachers.

I think he eventually sold off most of that though to start the larger project in Florida from scratch. I think they had problems with all these super-religious kids living in thier dorms, when right outside you have state college kids getting wasted and making fools of themselves. Too much exposure to corruption I guess.

I dont see a problem with it though, if people want to start a new town from scratch, then let them. The people that want to live like that will move there, and those that dont, won't. Everyones happy.
 
Well, if people want to live in a place like that, more power to them. But one things for sure. I wouldn't be caught dead in a place like that.

If his development is private property than he wouldn't have problem. However, the residents should have to pay taxes. The laws on non-profits doesn't exclude the residents who live there. Nor, I believe property that is used commercially, even if it is owned by a church.

In Orlando North East corner there is a Lutheran retirement community (Slavia)- but it stays to itself and is mostly deserted -
except for the fossil farmers. (Decendants of the Duda family - Slavik Farmers)
Mormons have their clique in Utah, and they have proved to be quite isolationist in many of their ways.
Mennenites and Amish in the North East also stay to themselves pretty much as well,
except when they're out being absolute party animals.

But then again - none of them try to hold a town or closed community to the Stepford Wives Standards.
 
Since this community will be not be burdened with any unpleasantness, the couple who find that their marriage is falling apart will probably have to sell their home and move. Divorce will be frowned upon, and you won't be able to file papers.
 
The biggest problem he is going to have is if they restrict who is allowed to buy or lease the homes based on religion. There are laws in most states prohibiting that. And if he doesn't do this, he will not have the nirvana he's trying to attain.

He used to own the Detroit Tigers, but he sold it off to the other pizza guy from Detroit, Mike Illich, who owns Little Ceasars. Illich also owns the Red Wings as well as a lot of downtown Detroit real estate.

Monaghan sold off a lot of the material things he had collected before he went on this Christianity kick. He used to own quite a selection of classic automobiles, too.

There are exceptions. This will be a case to watch when it hits the courts.

Sec. 807. [42 U.S.C. 3607] Religious organization or private club exemption


(a) Nothing in this subchapter shall prohibit a religious organization, association, or society, or any nonprofit institution or organization operated, supervised or controlled by or in conjunction with a religious organization, association, or society, from limiting the sale, rental or occupancy of dwellings which it owns or operates for other than a commercial purpose to persons of the same religion, or from giving preference to such persons, unless membership in such religion is restricted on account of race, color, or national origin. Nor shall anything in this subchapter prohibit a private club not in fact open to the public, which as an incident to its primary purpose or purposes provides lodgings which it owns or operates for other than a commercial purpose, from limiting the rental or occupancy of such lodgings to its members or from giving preference to its members.

Not much religious tolerance of the Worlds largest (and oldest) Christian religion on these boards. I see better tolerance of Islam...

Good for them if they are tired of people bashing them. Good for them if they only want wholesome T.V. for their family. Good for them if following their faith makes them happy.

Me myself .....I'll let them be, while I watch "Family Guy" and drink a beer or six.
