Age of consensual, why does it vary from state to state?

This is one thing that has always boggle my mind - why does the age of consensual vary from state to state? If it's a federal statue, then why does it matter? You mean to tell me I can tap a 16 yr old ass in one state, and as soon as I cross the state border to another one I can go to PMITAP?

Someone gotta do something about this, just pick a freaking number and stick with it across the land.
 
i always heard "old enough to drive a stick, old enough to suck a..."

Places where oral sex is illegal: Alabama, Arizona, Florida, Idaho, Kansas, Louisiana, Massachusetts, Minnesota, Mississippi, Georgia, North and South Carolina, Oklahoma, Oregon, Rhode Island, Utah, Virginia and Washington D.C.

In Washington State there is a law against having sex with a virgin under any circumstances (including the wedding night!).

In Washington D.C. there is a law against having sex in any position other than face to face.

It goes on and on.

This is yet another thing that does not belong in the hands of the Federal government. States should be free to choose how to shape their populations and the way they live.

You can't cross state lines just for the acts of sex and avoiding prosecution for age of consent. So, if you are having sex with this girl and the parents press charges or some shit... you'll be screwed no matter what state you did the act in.

Anyway, it's not like that matters... You're never getting laid anyway.

I can guarantee you that I've had more than my share of women, probably more than all the posters above this post, combined. It's OK though, keep projecting your failures upon others.

But my point is that, it's a federal statue, so it doesn't make any sense that if I'm a citizen of this country, I can screw someone in some state and it'll be fine, and will be fucked in another.

Edit: Didn't see Alkemyst post up there, probably same number wise. So excluding Alkemyst on the women thing...

How is this any different from other state laws? Compare Idaho and New Jersey with regards to gun laws, for example.

If it's a federal statute (is it? never paid much attention to this one), it only exists to tell states that they must establish an age of consent. There might even be a federal minimum, not sure, but states are free to decide how they want to work things inside of there own lines.

It's much the same as to how alcohol is regulated - certain states won't sell certain strengths of alcohol in different categories, say, everclear at 190 proof isn't legal to sell in every state, and some beers around 20% ABV are not legal for sale in some states.

Education is also another similar state-level thing: federal says you must establish something for education, and then the states do so but with their own style.

And as was stated above, gun laws are yet another example of States deciding how they want to handle things.

We need to take things away from the Federal government, not give them more. We don't need the federal government holding our hands, we need to make sure they are only setting the precedents and setting the guidelines, states don't need to exist if the Federal government is taking care of everything you can name.

That's probably I don't care about gun laws.

Why did we want to complicate ourselves though? If you can be prosecuted under a federal offense, shouldn't the law be the same in every state? You know, this is a country after all.

I just thought that it's simpler for our legal system if we have some sort of standards, and not "up to your discretion" sort of deal. So if some states decide to go way off the deep end, it's OK too?

10th Amendment ?

States can make any law they wish, and do anything they want, so long as it does not go against Federal laws and statutes.

And there's also the issue of the Federal government can withhold federal funding for state projects if a state decides to go a little too far [in the eyes of the Federal government].

Also, do you understand why we are technically called a Federal Constitutional Republic, and not a simple democratic republic or something?
The true definition of a "State" is a sovereign entity. The states in the U.S. are not entirely sovereign, but in general terms there is a shared sovereignty between the Federal government and the entities that comprise the Federal Republic.
And all this is defined in the Constitution, thus why we are a Federal Constitutional Republic.

So... why do we hate the U.S.? 😉

Regardless, it varies because..well, because it does. I don't have a good answer other than states make their own laws.
 
A lot of it has to do with religion. Take a look at Idaho and their 14 years old - that is probably due to the church of later day saints.

Depending on how strong the religious right is in the state, the stricter the laws seem to be.
