Advice/help needed on being accused of child abuse

looking for advice for a friend that is in a tough situation.

his gf reported to police and child services that he abuse her daughter. they taped the interview of her reporting that he abused her, and daughter was taken to the hospital for examination. the police never contacted him and got a search warrant to search his house that both him and his gf and daughter lives in. he and his gf talked and she agreed to tell the detective the truth that it was all a lie and nothing happened. the detective refuse to withdraw the case and request that the gf and daughter come in for further investigation. gf and daughter chose not to participate since there is nothing further to investigate, they have already told the detective it was all made up and was a lie. detective have not yet contacted my friend. detective have not yet contacted the gf for a week now. is the investigation still on? is the case withdrawed?

any advice or help is appreciated.

Tell them both to seek couples counseling. There is no excuse for people to fight like that. If they get their conflicts worked out properly, the legal issues will not be that serious.

First of all, is she still his girlfriend? I would be pressing any and every charge I could against someone who knowingly falsely accused me of abusing my daughter. Then I would drag her through civil court.

Filing a false police report is against the law...They kinda frown on that kind of stuff.

It sounds like a common thing when one parent is setting up a case for custody.

He needs to be proactive. If he sits around waiting, he could lose custody and possibly face charges if they let it get out of hand.

Tell your friend to get a recorded confession from his girl that she lied to the police. Then he needs to pack his belongings and GTFO.

My guess is that the detective does not believe that it was a lie in the first place. I have seen many cases where there was reported child abuse and then it was recanted for one reason or another. When there was an initial report, then the family gets together to discuss it, followed by everyone saying it was made up is a big red flag.

Also the GF will be in trouble for filing a false report if it is indeed a lie. Tell him to talk it over with a lawyer.

From what you wrote I assume that the daughter is hers and not your friends ... correct? If she is not his then what was she thinking? There is a lot you are not telling us and without that info how can anyone provide the correct advice?

This gf sounds like a winner. if he stays with her then he deserves what he gets ...

first off you should get a lawyer 2nd have her come in and talk ot the lawyer and record it.

edit: and when the detectives come to talk to you. say you want your lawyer and keep your mouth shut!

Well, he should get a lawyer to be safe. But the dumbass gf might get charged with filing a false report.

As she should. Anyone that uses abusing a child as a pawn in their relationship chess game deserves to have their kids taken away. Since that won't happen hopefully at least she will get a talking to about filing a false report and that will scare the piss out of her so she never does it again.

The detective may be required to check it out because there was a complaint filed. I would expect Child Services to be taking it from this point, though, not the police.

actually both will look into it. At least here in Il both child services and the police will.

and i agree with thepd7. any parents that use a child in such games need to be shot.

based on the OP I don't think english is his main language.

In child services issues the problem is is even when something is reported inaccurately they still investigate it until they are satisifed and let's face it if a couple are making false police reports on each other...it's probably not the best home life.


To the police the case is probably closed, to child services it's not.
