adding paypal fees against TOS -

can anyone find post the link to where adding fees for using paypal is against their TOS?

I apparently fail at the google.

thanks.. i can't access ebay from work - which is probably a really good thing.

i'm just seeing a ton of FS posts on another forum where they're adding PP fees and it drives me nuts

A person can add any fee/charge they like as far as I know. Its you can't do it on eBay.

Okay, here you go.

4.5 No Surcharges. You agree that you will not impose a surcharge or any other fee for accepting PayPal as a payment method. You may charge a handling fee in connection with the sale of goods or services, as long as the handling fee does not operate as a surcharge and is not higher than the handling fee you charge for non-PayPal transactions.

While it does specifically mention eBay in 4.2, it mentions seperately in 4.5 that you can't add it period.

4.2 Use of PayPal on eBay. Sellers who offer PayPal as a payment method in their eBay listings must follow these requirements:

1.

Accept PayPal if the eBay listing includes PayPal as a payment method.
2.

Accept all PayPal Payment Methods from a buyer, including but not limited to eCheck and credit cards.
3.

Have a Premier or Business account or be willing to upgrade to a Premier or Business account upon receipt of a payment.
4.

Accept international PayPal transactions if the eBay listing offers shipping outside the US.
5.

Sellers may not charge a surcharge for accepting PayPal as a payment method.

i hate what it has become but wtf, the alts simply aint as reliable(at least in my experience
ebay needs a direct comp.

You can't add a surcharge but I think you can offer a cash (or money order) discount, which is effectively the same thing and what some gas stations do. Their agreements with their payment processors also prohibit adding surcharges for credit card use.

No, the Anandtech FS/Trade Forums policy is to slavishly follow Paypal's "can't charge someone extra for using a credit card thru Paypal" account policy, even though it can only apply for eBay and other points of sale (ie: Newegg) where the seller has a "set price" for both: the merchandise and for the postage. The Anandtech FS/Trade selling prices (and similar-type sales) are always negotiable, and thus cannot (and should not) be governed by this Paypal "policy".
But: there you are...

If you trust your buyer/seller then use the gift payment option. You don't get buyer protection, but you don't get charged any fees.

Anyone with half a brain just adds the fee to their price and doesn't mention it.

Is this really controversial? The only people who don't understand that fees (surcharges) are illegal are sellers trying to make an extra buck and are too dumb to figure out workarounds.

They are not illegal. They are against Paypal's policy.

Why shouldn't they be able to add PayPal fees? You just expect the seller to eat the loss on these? It's not uncommon for people to have two prices for an item they sell: One for CC PayPal, and another for non-CC PayPal, money order, etc.

Even if they don't have a separate fee for it, most sellers factor it into their asking price.

But if you go so far as to plainly state that sort of adjustable (CC vs. non-CC Paypal) pricing in your FS/Trade ad, you get dinged by the Anandtech forums moderator.

It's the same thing in the real world man..
You don't go around saying things when you're doing business but everyone acknowledges it. It's the same thing going on with garage sales / flea markets where probably 98% of sellers do not write an inventory or calculate for annual taxes even when they're supposed to.

Some of the gas stations around here give you a discount if you don't pay with a credit card. I think its legal to give a discount, but not to charge extra.

I would include it it the asked for cost or in the shipping / handling, which encompasses my time to Pack, Address / Label and Ship the item. In some cases, like golf clubs, finding a suitable container, say for a 46 inch long club, is hard to do or it costs $6 or so to buy.

Just include paypal fees and shipping into the final price. I hate seeing stuff for sale without the shipping fees and terms listed.
