not to mention i live in a small small town (maybe 50-75 houses) so traffic is light.


i have it in the paper for sale. getting a lot of calls. i soppose if i dont sale it in a day or two turn it into her insurance.

if i have to take less and have the lady make up the diffrence.

sigh i really do not know what to do. soppose get more advice sigh.

Well obviously you don't want our advice, because if you did, you would have a settlement from her insurance company by now, and you would be selling your car for ($700-(settlement amount)).

she gave me a check deposit ticket (minus the numbers on the bottom) that has her name address, phone number etc.

on the back of it she wrote her insurance information. etc


No we did not call the cops. they wont come out for something like this.

true.

the car has a few smaller dents. seems mean/rude/rotten etc to turn it in. she was honest and came in and told me she hit it. granted the parking lot was full of other church people.

i really do not know what to do. on one hand she did hit the car and i want to sale it anyway. on the ohter hand a big dent is going to make it harder to sale.
?? where is the confusion? This is why she has insurance, for things like this. Turn it in, it isn't like you are suing her for the neck injury that you magically developed even though you weren't in the car...;)

actually no i wouldnt considering it happen this morning and i wanted to get advice to figure out what the best thing to do is.

also wanted to talk to my father (went to his house for a BBQ, B0day party. my daughter turned 4 friday!).

he suggested calling the lady up and asking for $2-300 and then try to sale it. if they say no just put it on the insurance and sale the car for whatever i can.

I think that is what i will do. still thinking on it.

I hate to put it on her insurance but i don't want to lose any money heh.

Drive it over a cliff and report it to her insurance company, claiming she ran you off the road.

So your moral dillema doesn't lie with the fact that this woman will be out some cash, it really hinges on whether or not you will be shady and ask her for cash directly, or do the morally and legally correct thing and report it to her insurance? You aren't making any sense man...

well yeah. the car is a pill of steaming crap. i paid $50 for it. i do feel bad about either taking cash or reporting it to her insurance (wich may go up).

but on the other hand the car will sale for $600-700 but will be harder to sale due to the dent and sideing being loose.

i shouldnt feel bad about the idea of putting it on her insurance. thats what it is for and she did hit the car. but i do heh.

I still wouldn't care. I did read the thread :) You are not going to get less for it. with a dent or lose bodywork. a running drivable car is worth >=$500. A running drivable car with one larger dent and lots of smaller ones and lose bodywork is worth >= $500.

Turn it in to the insurance. It's not being an ass to do so...If the estimate is more than you are trying to sell the car for, (which isn't out of the realm of reality) then pocket the cash, and sell the car for whatever you can get for it...Doesn't matter if the fender/door/whatever already had dents, she did damage, and you're entitled to some compensation for the damage...Heck, if the repair is expensive enough, offer to just sell the car to the insurance company instead of having it repaird. Most likely, they'll offer to total it (as rebuildable) and cut their losses on the deal...

Just tell her you were selling it for 750 or whatever before she hit it, and tell her that you expect her to pay the difference between what you get for it and your original asking price.

It is the other way around DaiShan. If he turns in a small claim into her insurance it will cost the insurance company over $1,000 to process and pay out a totaled car amount of $750 or less. It will now cost the nice honest church lady hundreds in raised insurance premiums over the next three years!

Waggy is doing her a FAVOUR by offering to take a few hundred from her instead of turning her into insurance.

Of course if he just forgives her trespass he may end up with an endless supply of baked goods and possibly be know as Saint Waggy by the church folk across the street.

Glue the loose plastic piece and sell it to the guy who wanted it for $700 or less.

Waggy. This is not even a choice man. I had a 96 grandam that recieved a big dent from a similar situation outside the post office, and the dude had a brand new escalade. My car had slighty faded paint, but it still had resale value. I got an estimate, was like $300 to fix. I let it slide man. My family was telling me, why'd you let it slide that guy is loaded with money. I thought to myself that one day I'd probably be in the vice-versa situation and I'd want it to slide too. Iam a Christian as well. You were coming from Chruch, just forget about it man. Dont be hounding down anyone about a dent on your beater concerning its future resale value.

Well, you can't exactly stick your car in a safe, now can you?

Just take the insurance check and sell it. You're going to make more money on this deal than if she hadn't hit you.

Umm, or maybe he doesn't want her insurance company to jack your rates? How is that morally appalling? The only shady thing would be if he asked for money, and then filed a claim anyway.
