Can't do that. However, if he's truly a good friend...and not afraid to lose his job, he can testify that the company, management and other drivers all conspired.

Concealed weapons permit, carry a firearm, always have a video camera to record what's going on. Frankly, if I was ever assaulted, there'd be no "you are not to do anything but call the boss". I'd be pulling out my 9mm and that guy would make sure he'd never touch me again. Then I'd have a video camera installed so it's recording everything that's going on. Without that, your word against his?

This was the second day in a row the same driver pulled the same stunt.

IMO The larger vehicle has the right of way.

 There's really no way to say what would be appropriate without seeing the layout of the entrance.

Call the police and press charges. You have pictures of what happened and hopefully you boss will back you.

You and your crew are being fucked. Are you gonna bend over and take it? Then what are you waiting for? Get some guys together and go see this driver when he shows up to work tomorrow.

this may be a longshot but when you set the phone down, was it off? I can't help but wonder if the phone was still on and connected with your mom she may have heard scuffling or something....

also is there any surveillance footage around the gate area?

Seems like the guy meant business and walked all over you. What did you expect to happen? Take a self defense class or something. I'm not big by any means, but I surely hope I'd never let this guy lay hands on me like that. I'm not afraid to take a beatdown. In most cases, a guy's not going to beat the shit out of you if he knows he's wrong. If he does, then there's your lawsuit. In this case however, you got punked and didn't stand your ground, so there's nothing really to sue over. Better to just move on. If you do go the lawyer route, keep your upfront expenses to a minimum, cause you'll likely not get them back.

Get a TRO against the driver, next time he comes to your place of employment call the sheriff and have him arrested for violating the restraining order.

It sounds like your boss doesn't really care about you. Definitely file a police report and start looking for a new job. If something happens again between now and when you leave for another job, kick the guy's ass.

Seems like he's doing the proper thing. Attackign the driver back opens up teh company to litigation as well and would only exacerbate the situation.

Any updates OP?

yes he is doing the right thing by pursuing legal action, however he also has the right to defend himself in any situation where he is being physically assaulted.

and what i said in my first post i meant it in the nicest way possible.

I can't believe nobody has told him to pee in the truck yet. Remember how well it worked on the UPS guy?

Your company has rules in place saying that in the event drivers become argumentative
or confrontational that you aren't to fight back but are instead supposed to call the boss?
Seems to me like this rule indicates that such things are a fairly regular happening and that driver
acting out is a problem well known to management.

You need a lawyer ASAP

Wow your company sucks for not standing up for you. Also, what sort of business are you in where companies pull shady stuff like this? This sounds like high school. I cannot imagine a serious company not only blatantly lying but getting multiple employees to create a whole fictional story to crucify you.

Personally I think having anything close to that in writing is shens....

I think the OP decided on his 30th he was finally going to become a man and stop some dude in a semi so he could pass first.

Dude got reassigned to bitch again...

I don't have any advice for ya cause I'm not sure what I'd do next either, but good luck. Sounds like someone needs to nuke that fucking trucking company.

Assault is your word against his.

The only thing you can do now is get revenge.
I would start by slashing his tires. (on his personal car)

So self-defense is illegal now?

This ......... is a beautiful thing. You were assaulted, you fear for your safety. This would be a wise and prudent thing to do. It's perfectly legal. This would be the best way to show all the parties concerned that you're serious about this. In addition, it will cost the driver some money. You'll be getting back at him legally and through his wallet.

Your best advice here in my estimation. Getting a lawyer is good too, but expensive.

Start looking for work though. It will create a situation where one of you has got to go (you or the driver) and your employer has more or less made it clear that they are not going to back you up. But the truck drivers employer may be able to assign him to another route or whatever. It could possibly be resolved that way.
