Assaulted at work by a driver from another company
Called my boss
Have pics for proof
Had meeting at the drivers company with his boss and mine
His company refuses to fire or reassign him stating they beileve him
Now what?



Simple background. I work at a facility in the woods by myself all alone. The company I work for is small maybe 15 employees. Just 3 employees work at my facility. We work 12 hours on 12 hours off then 4 days on 2 off. Rotating nights to days. Currently we are short one employee at the disposal and I work everyday until someone is hired and trained. So far I am on week 3. Prior to that we had trainnee for a few days before he quit. I worked 3 weeks straight before previous employee was hired. So in 6 weeks I have had 1 day off.

Semi trucks hauling salt water, oil, and plain old nasty shit drive to my location and unload the water into a pit. I am charge of pumping the water out of the pit into tanks and then down into the ground.

The truckers are employeed by a seperate company. Theres about 5 different companies that haul water to us. I have been here for 8 months now. Super easy job... I have had issues with one driver not listening to me. Emptying water when the pit is full. Not using filters when emptying his truck. Very confrontatinal person. The previous 3 employees before me had issues with the same driver.

It came it a head on wensday the 22nd. My 30th Birthday. I got off at 6pm and started to leave the property. Its a gated property and the gate is only large enough to fit one vehicle thru. I have to exit my vehicle and press the button to open the gate. As I was entering my vehicle, a semi truck pulled right to the gate and stop blocking the exit. This was the second day in a row the same driver pulled the same stunt. This time I was not going to back up so he can keep walking all over me. Heres the best part, I am on the phone the whole time from pressing the button to the assualt with my mother. She called and wanted to discuss birthday plans for that night.


So, I am in my truck on the phone and he exits his truck and walks directly to my drivers side door. He then starts to yell and curse, so I ask my mom to hold and set the phone down on the seat. I exited the vehicle and explained I wasnt moving my truck. I was there first, I pressed the exit button. His side has a numberic keypad and no he never got out to press any buttons cause the gate was opening as he pulled into it. The driver got extremely irrate and grab me by arms and ribs and slammed into the drivers door of my truck and contiued to hold and squeeze me while I yelled get the hell off me. That went on for about a minute and the driver finally released me. I instantly called my boss. We have been told if there is ever an occasion were a driver hits us, we ARE NOT to hit back but call the boss. So I call my boss, explain what happened moments before. He requested to speak to the driver. The driver at this time walked back to his truck got in the cab and pulled out his phone and took a picture of my truck to attempt to say I was blocking the road. My boss gets onthe phone with him and he denies it all.

I get back in my truck with my phone and back up and let him around me again. Its a 45 minute commute home. Now by now means am I saying I was thriving in pain but I could tell I had a few scratch marks on me. When I got home I had a bruise on side and scratches on either side of me. I took pics called my boss and explained I will not be returning to work if that driver is allowed to come back to my facility. He assured me thursday morning I would not see that driver until after we had a meeting monday with the drivers company.

Saturday and Sunday the driver returned multiple times. Each time a driver unloads water he must fill out a ticket book. Monday I show to work at 6am like every other day for the last month. At 9am, I am relieved from work and head 30 miles to the meeting. The driver was absent from the meeting becuase of Jury Duty. I explained what had happened to the drivers boss and the drivers company safety man. I showed them the pictures and stated I wouldnt be returning to my work if the driver contiued to haul there. They explained there driver was a saint and would never do that. I even explained that he came back to the facility over the weekend when instructed not to by my boss and his drivers boss. They wanted proof. We turned the log books over to them showing he had been to the disposal 8 times over the weekend. Since the driver wasnt there, they would make a decision after he returned from jury duty and they had a chance to talk to him. That was last night, the driver returned this morning. I called my boss and asked whats going the drivers back. He called me back and found out the drivers boss sided with the driver and found that no violence took place. He then explained to me that the company safety was appealing the decision and he would hear back shortly from him. That was about 3 hours ago.


The drivers company had a saftey meeting last night and explained to all the drivers they were having an issue with me and they would hopefully have me fired by tommorrow. One of the drivers is a close friend of mine and called me afterwards to explain. As of noon today, I have been called twice by my boss stating he is getting complaints from the drivers boss that I am yelling at the drivers and causing issues.



So what do I do? What can I do?

And if you can get your friend to get in on your side you should be able to make even more money and split it with him when you win.

They are going to screw you. Hopefully someone here has some advice for you. All I can say is communicate with your boss and fight it.

Call the police, forget your company, they aren't in charge of prosecuting or punishing criminals.

File a police report ASAP.

Then proceed with whatever you can and press charges against him.

You should have filed a report the instant it happened.

I would find a new job. Honestly, your boss probably needs that business if he only deals with 5 companies.

Why should you not show up to work, just go to any attorney at all and they will open a lawsuit and the driver will be suspended before that lawyer even hangs up the phone?

Sue your own company for endangering your life. Make sure you tell the jury you're emotionally traumatized so they can reward you with $3 million in frivolous damages. In addition, sue the company the attacker works for another $3 million for cutting off your conversation over the phone w/ your mom. You're set for life son.

Start videotaping any contact you have with any of the truckers. Sounds like the trucking company is lying through their teeth and right now, it's your word against theirs. That way, you have documented video evidence which will probably be useful in the event that they do fire you.

Tell your boss that the only other guy working is gonna have a hell of a time working 24/7 when you leave...

This. If your serious about persuing this, call the police and file a complaint against the driver. That will force both companies to actually deal with it.

I suggest the same. Record your interactions with the truck driver(s).
