A trade went bad: Do i have the right to exchange back?

I had a trade with a "reputable" trader here (154 positive heatware then) and the trade is I exchange my 30 and 40 Gb hard drive for his 80 Gb hard drive. So he asked about the warranty status and i checked it and told him the warranty date (2005). And i asked him about the warranty status on that 80 Gb and he said he was going to call Maxtor and check with them, but he was sure it is until 04/05.

So today i received the hard drive and the i checked the warranty status on the hard drive, it's warranty until 10/14/03, only 10 more months. So i PM him and asked for exchanged back the hard drives i sent. And here is his respond :

I said it should be good untill 04/05 I didnt say yeah it was definately good till 04/05. I never even checked it because you didnt demand a warranty check. If the warranty was the case why didnt you ask for a definate warranty expiration?

I think it was a fair deal and I shouldnt have to swap back(you getting 10 free gigs). So I was a little wrong on the warranty(by a couple months). Not to mention the 40gig got tossed around in the box during shipment where it was poorly packaged.

Looks and sounds good. Let me think about it for a day or so but so far yours looks like the best offer(as for it being bought new and stuff). Do they have a warranty date on them?

hehe I think we ran into some trouble. I currently have some data that needs to be backed yo also. About 40gigs. We will have to figure something out if we did the deal.

If the drives are retail you should be able to look on them for a manufacture date. Shouldnt need the serial #.

If you don't mind used I bought a Verbatim(rebadged Lite-On) for $30 shipping which wasnt bad. Saves the hassle of rebates/coupons.

I would burn my stuff but that would take way to many CD's.

Wasnt a offer was just a suggestion. Myself I have never bought something that required me to send a rebate in. Rebates=evil IMO. LMK if you want/can to trade the HDD's I could use them in my systems.

I don't know how you get 154 positive heatware, i didn't ask for a certain warranty date because you said it should be until 04/05. And now you are using the excuse it's poorly package and i got free 10 gb? How about you didn't sent it on time? how about not notifying you had sent out the hard drive and i'd to ask for the DC number? How about i had to buy a 80 gb to back up the data and then send out the hard drive first? I didn't complain at all because i believe the trade should be deal as promise, and a promise is a promise. You said it's warranty until 04/05, you said you will call maxtor and checked the warranty status, you ask how to check the warranty date and i sent the link to you. I kept all the pm history and i won't settle for less unless we exchanged back the hard drive.

So I was a little wrong on the warranty(by a couple months).

A little wrong on the warranty? 10/14/03 and 4/05 are completely different a year and a half different. He gave you an implied agreement, I think you should get your HDDs back. A free 10 gigs isn't going cover you if that hard drive goes bad.

I never thought i would get into this much troubles trading with a reputable trader with 130+ positive heatware. Obviously I was wrong. :(

He didn't say "I think" or "maybe" he said "I am sure" which I would take
a person's word for it if he said "I am sure" if I was dealing with him and
he had the feedback rating level that he has.

I've had a few deals where the users were unknowns and they were vague
at best at the condition of the item so I just passed on the deal but you would
expect a good trader to be sure of what he told people about what he was
selling/trading or be willing to live by his word.

It is short on the warranty that you thought you were getting so there is some
loss of value.

The trader made a statement and he should live up to it. The fact that you might
not have packaged the drives up to his standards doesn't excuse him from delivering
what he told you his drive was.

I think you should un-trade. 2 years of warranty on a HD is basically a free HD at some point.

I hate this kind of defensive bullsh!t--

You didn't get 10 gigs free, that was what the trade was. A little wrong on the warranty != 18 months. Your packaging of the 40gb drive has nothing to do with the issue other than him being a whiney bitch.
