Actually, the public owns the airwaves that CBS broadcasts on. That is why the government can regulate the networks. So we DO own it, and we can bitch all we want. Say I owned a house (broadcast frequencies) and rented it out. If the renter (CBS) violated the lease agreement (first amendment) and started selling crack (or discriminating against ads based on political leanings), I could throw them out.

Right - but how do they decide what is controversial. Personally, I would say any bull$hit ad that the Whitehouse puts out is controversial, and that the moveon ad is nothing more than an artful statement of fact. But since the current administration favors media deregulation, ads against it are controversial according to CBS.

The commercial isn't combative or malicious, nor does it contain "fighting words." So by all respects, it should be covered under first Amendment rights. If MoveOn.org is willing to pay the ungodly amount for the ad time, CBS should let them air the commercial as outlined in their ad contract.
CBS not letting someone air a perfectly sane, calm and non-obscene commercial is discriminatory. It shouldn't happen, but unless someone moves forward with it quickly and gets a judge to issue a writ of mandamus, the commercial won't be shown.
