Actually, the public owns the airwaves that CBS broadcasts on. That is why the government can regulate the networks. So we DO own it, and we can bitch all we want. Say I owned a house (broadcast frequencies) and rented it out. If the renter (CBS) violated the lease agreement (first amendment) and started selling crack (or discriminating against ads based on political leanings), I could throw them out.

CBS doesn't discriminate based on political leanings, they discriminate based on politics. They don't air ANY political ads that may be considered controversial.

Right - but how do they decide what is controversial. Personally, I would say any bull$hit ad that the Whitehouse puts out is controversial, and that the moveon ad is nothing more than an artful statement of fact. But since the current administration favors media deregulation, ads against it are controversial according to CBS.

You're crazy if you don't think specific networks don't have a political agenda. Sure, there are legalities surrounding bipartisan advertisements...if X party gets a 30 seconds slot, then Y party is entitled to an equal length slot... but there are 1000 ways to still show favor towards the party the network uses.

Generally, ABC / Peter Jennings are democrats. Jennings hardly ever has anything good to say about Bush. Never! Always questions his actions / decisions.

CBS is generally republican. Whatever Bush does, they applaud it highly. Not too sure what NBC supports.

EDIT: And by the way, when it comes to media / television, you're either an elitist or a popularist. An elitist feels that the media owes some responsibility to the public, while a popularist feels the media can do what it wants [to make money]. I'm an elitist.

Now if there was a commercial about Clinton killing Vince Foster...

It's their network... they can do what they want. Why is this such a hard concept for idiots to understand?

Sure, they can do whatever they want, but if MoveOn.org takes the initiative, they can file suit against CBS for infringing on their first amendment right. The commercial isn't combative or malicious, nor does it contain "fighting words." So by all respects, it should be covered under first Amendment rights. If MoveOn.org is willing to pay the ungodly amount for the ad time, CBS should let them air the commercial as outlined in their ad contract.

CBS not letting someone air a perfectly sane, calm and non-obscene commercial is discriminatory. It shouldn't happen, but unless someone moves forward with it quickly and gets a judge to issue a writ of mandamus, the commercial won't be shown.

Bwahahaha.... *breathes* ok, I think I can type now. But I'll be typing this slowly, to help you comprehend, because apparently you need all the help you can get. First of all, yes, the group that put together can sue over not be aired. But I can sue you for being an asshat and wasting some of my time... it doesnt mean it wont be thrown out of court, just that I can bring a lawsuit against you. You can sue for ANYTHING, but that doesnt mean you can, will, or should win.

Your first amendment rights, as related to free press and free speech, allow you to say and print whatever the fsck you want. Much like CBS can print and say whatever the fsck they want, and they have decided, for whatever reasons, to NOT air that ad. It is similar to if you were running a newspaper, such as the "Socialist Worker" (I'm not accusing you of being a socialist, this is just one publication that makes it easy to set up an example), and I wanted to run an ad in it. Lets assume my ad was regarding the failures of socialism. If I offer you the cash, does that mean you MUST run the ad? That is your current position.

Now, if MoveOn.org has a signed contract with CBS and CBS violated that contract, that is another thing, called "breach of contract", and not really related to the 1st Amendment at all.

Now, as to CBS discriminating... all networks discriminate in which ads they take. Viewers have been known to boycott programming if they do not like the sponsors. Its capitalism, get used to it. CBS is not going to accept any ads that might make viewers more likely to change the channel during the Superbowl. So, no aborted fetus, no starving Africans, and no controversial political spots, either.

Of course my bias is 'dripping.' That was my point - my bias was obvious on purpose to contrast with CBS's bias. My point is not that they should air Bush's ad, just that they shouldn't be able to air one and not the other. I'm not trying to bait you into a political arguement or anything. Plenty of people disagree with my point of view, and if I wanted to argue that, I'd head over to P&N. The point is that everyone owns the airwaves, everyone and their different biases. The network cannot just air their own.

MoveOn.org - there's a source for quality news.

What's even more pathetic than MoveOn's "reporting" is that people actually BELIEVE it. People this is a tabloid. They're no better than the paper in the checkout lane with the three-headed baby.

A smart person would research for the truth behind the story before commenting on it, but apparently that's a little too much for moronic ATOTers

Do you know ANYTHING about the first amendment? MoveOn can say whatever they feel like. They can put whever they want on their website (like their commercial), but they can't force a company to air their ad. That would be like you telling me to run around claiming that we should overthrow our government and me not doing it, then you trying to sue me for infringing on your first amendment rights. It doesn't work that way, and you are a total idiot if you actually believe that it does. Of course it's discriminatory, but what isn't? Discriminating is NOT illegal (despite what your current 4th grade teacher tells you). If it were, you would be put in jail for discriminating against Bush. Wake up and start living in the real world.

I don't need to. It's been explained quite thoroughly.

Note the common thread between both ads that aren't being played.

That's right folks - they both reek of bullshit!

Even though I think the people who made the ad are sniffing too much crack, it was actually a very cool ad.

Too bad for the ad-makers, reality shows that the tax cuts really are jumpstarting the economy and soon the deficit will be shrinking lower than when he started. I work at an Accounting Firm, I see it in action...

The point is, first amendment doesn't really apply, because CBS is a private network, and can thereford pick and choose whichever companies ads that they want to air. There's no law that says that just because you have the money you automatically get some airtime during the Superbowl.

Props to CBS for realizing that nobody wants to see political crap during the biggest sporting event of the year.

But CBS (according to MoveOn.org) will be showing political ads sponsored by the White House. Interesting choice of ads to air.

You guys are right though - there would be no grounds to sue CBS unless it was a public company.

Yes, they most certainly can. It's their network. Just like the network that has Rush Limbaugh on doesn't also have to have a liberal talk show.....first of all, there's no market for one anyway, and they're in business to make money, but mainly, it's THEIR network, and they can have on whomever they want.

But those subtitles aren't there. And in my opinion, those are okay things to go into debt for. But I don't think the US should be in a trillion-dollar deficit to pay for $87 billion of Iraq reconstruction aid, or for tax cuts that will have absolutely NO impact on either me or my parents. Add to that the fiscal crisis that many of our states are in, and my tuition could be going up >10% next year.

Right now, I'm asking myself if I'm better off than I was four years ago. No...my family and I are doing MUCH worse. But we're making more money. How could that be?

Ther only law covering political speech on privately owned, but publically aired networks and radio is the Equal Time Rule.

The Equal Time rule is a Federal Communications Commission rule that requires equal air time for all major candidates competing for political office. It was preceded by the fairness doctrine, abolished in 1987, which required radio and television broadcasters to air contrasting views on controversial public issues.

So no, in no way is CBS legally or morally obligated to show this, or the PETA ad... or any ad for that matter. And as a business, I wouldn't show them either. They have people lining up to pay for advertising during the superbowl. They wont lose any money by turning down these ads, but WILL keep controversy to a minimum.
