A little problem with paypal

Tell me your guys on opinion on this and what I can do about it.

I sold a guy a sealed roomba robotic vaccum on ebay for $300. I went to test out the unit before I shipped to make sure it wasnt defective and it what do you know it is. I had to ship it back to the company and wait 2 weeks for a replacement. I told the buyer this yet he filed a claim through paypal for his money back. He won the claim WHILE the unit was in transit to his home. He ended up keeping the money and the roomba and not giving me a penny back. Paypal is not being to helpful as they stick to the fact the guy won the claim. Anything I can do?

THe product was sealed and sold as sealed. Why would I open it up unless the buyer wanted me to?

nothing you can do. send him an invoice for the product. If he doesnt pay it, you can sue him for it, but that might cost more than it is worth.

It is a good idea... mentioned above... to call the postal inspector. what he did, was in fact, postal fraud.

IF you send him an invoice, and he doesn't pay, can you hire a collection's agency to collect the debt?

Its a crime and probably mail fraud if you used the USPS in any fashion. You should alert the state attorney generals office of whatever state he lives in and give them all the info you have.

Or

I suggest you write or phone the police local to the guy - might be better to write and then phone, more formal that way.

Police will usually investigate a complaint, but whether or not the person goes to court depends very much on the local law WHERE THEY ARE.

For instance, in the UK this would possibly fall under "obtaining goods or services by deception" rather than fraud. Although I'm no expert.
