The law says it's okay to drive while drinking soda.

The law says it's okay to drive after a couple beers(less than .08).

The law says it's NOT okay to drive while drinking beer.

That doesn't mathematically add up. But go figure, politicians decide what's best for us :)

If it's not the influence that matters and it's not the beverage in hand that matters...what is the factor?

You already have a thread where you advocate drinking and driving, no need to start another.

I dont know... For some odd reason it actually makes a lot of sense to me as well as other drinking laws. Maybe it just takes a couple of close ones that have been killed by drunk drivers to understand though... Not sure it might just be me.

How many people do you think that drive while drinking a beer have less that a .08 BAC? If you think there is no difference between drinking a beer and a soda while driving... there are a lot more laws that you should have a problem with.

I believe that having an open container and driving drunk are two seperate laws.

OK, so,

1. Beer != Soda, so being allowed to drive with soda but not with beer does add up.
2. The law states it's ok to drive AFTER a couple of beers. Thus drinking beer whilst driving, is not driving AFTER drinking beer.

Adds up.

If it's okay to drive while under a little influence and it's okay to drive while drinking a beverage, why can't that beverage be the thing that puts you under the influence?

This is to not screw over people who say eat an alcoholic cake of some sorts or have had one a few hrs ago with meal etc.

They could impose a strict no alcohol prior to driving ban but that would be too harsh on people.
