1. It most definitely is WalMart's fault that this accident occurred.

2. Your lawyer sucks. What they meant is that there isn't enough money in it for them.

3. It doesn't matter what WalMart's insurance tells you about the cleaning company being responsible. Their job is to get rid of you without paying anything. You were on store property. If WalMart wants to get money from the cleaning company to cover your claim, that's their problem. If you expect them to call you back you are a fool.

4. I lol'ed at this part "They never once called me to ask how I was."

All I want is for them to at least acknowledge what happened and that it was their fault, and pay for the $200 jacket their cleaning solvent ruined + my doctor bill.

I don't think that's asking much.

Instead, they'd rather ignore me and blame it all on the cleaning crew. Sure, it was the cleaning crew that put the solvent down, but they work for Wal-Mart. The way I see it, Wal-Mart is ultimately responsible.

take is to small claims/magistrate court if that is all you want, you can do it yourself , not mess with a lawyer, if it is straight forward and you have reciepts and proof and stuff , just do it yourself

If you got hurt, you should have. My grandmother fell on a broken curb stepping up onto the sidewalk and was injured. She successfully sued the city, as well she should have.

I think you're being a little naive about the whole situation. They aren't just going to cut you a check for what you're asking if they don't have to. You need to be aggressive and go after what's yours otherwise you're never going to get anything.

The reason I said they never called me is because I was told by the assistant manager that the manager that wasn't there would most definitely be calling me.

I know that I'm not going to get anywhere without being aggressive. That's why I contacted a lawyer.

Dood that sucks. Like you've already done and said, the best thing to do is contact a lawyer - they're not going to cut you a check for no reason and certainly aren't going to respond to seemingly "empty" threats from you. A lawyer delivering a notice of suit to the store manager will definetly get something done.

And I've always hated Wal-Mart. I absolutely refuse to shop there unless I have to. (They're the only place open past 8pm that has my type of headlight in stock so I had to get it there) Otherwise, Super Target is the only place I go to.

This happens to everyone, and only a very small few think aobut sueing.

This happens to everyone, and only a very small few think aobut sueing.

It's not about fault - it's about liability. It's just a sad fact of business nowadays - you're liable for pretty much anything, and you can't always cover your @$$.

Isn't it sad how us idiotic Americans have this mentality, demonstrated quite well here, that anything bad that happens to us has to be someone else's fault? When I was a kid one winter we were standing outside shoveling the sidewalk when this old lady was walking down the sidewalk. She stopped, looked around, and then collapsed to the ground, right in front of us. No slip, no trip...looked around and then slumped to the ground. She then cried bloody murder about what poor condition the sidewalks were in, and refused to get up until an ambulance came and hauled her away. Of course the lawsuit followed not too long thereafter.

I'm not saying that you didn't fall legitimately, but there is someone else on the other end of the lawsuit, some poor slob who probably makes a lot less than you, who is going to suffer because you slipped and fell in his store. Yick. This kind of stuff just make me want to leave the country sometimes.

I would have been so embarrassed about falling on my ass that I would have left the store and felt fortunate that I wasnt laughed at.

I would have thought that a person might have smelt the cleaning solution if it is strong enough to ruin your clothes. Wal-Mart uses those big ass floor cleaning machines, you can hear and smell those things a long ways away, you didnt hear or smell a thing that might have given you an indication of what was going on?

Couple of years ago my Mom fell and broke her ankle in a restaurant parking lot that was covered in ice. The only person she blmaed was herself for not paying attention. She was on crutches for 90 days, ankle still bothers her on occasion.

Thats a given, nobody I have ever known has ever been "fixed" by these guys. They survive on return customers.

I agree but when you REALLY hurt what do you do? A regular doctor can only give you drugs, which really don't help either. You get TEMPORARY relief ofcourse, but depending on the drugs you could end up with a habit, especially for chronic pain. Jolting, shaking, and impact to the body actually do cause damage, that is why people go to jail for shaking their kids.

I understand that lawsuits are not necessary in every instance, but legitimate fall and accident victims really do have pain, and must have a financial recourse if needed. If you are not broken-up or deformed it does NOT mean that you don't have any pain. You won't be getting millions of dollars obviously. I have almost fallen in Walmart twice but caught myself. I could easily have fallen and sued them, but I would never want to be intentionally hurt, even minorly, to make a buck.

Wow, I'm sure that if they were more friendly about paying out money for people's accidents in their stores, that there might be more accidents in their stores. Know what I mean? Take a look at the customers in there. So many would be perfect candidates to "sue Burger King for getting fat..."

Anyway, sorry to hear about your fall, and I hope that you have success getting it taken care of.

I once hit a patch of ice on an otherwise dry road, and flipped my truck on it's side. Should I have sued the highway department for a new truck since they didn't have a "caution: icy" sign there?
If you're driving your car along on a hot summer day and suddenly slide out of control around a corner and total the car all because an oil truck ahead of you was leaking oil who's fault is it?

Just because you fell and didn't hurt yourself on ice (when it's cold you can see that it may be icy) doesn't change a thing here.

Anyway I go to Walmart because as Azraele it's really the only place in my area to get food unless I want to pay nasty high prices.

Man some of you people defending Walmart really blow my mind. If the original post is accurate basically we have this:

1) Guy walking around walmart. He's probably walked miles in walmart before and knows what the material coating the floor is like for traction.
2) Suddenly unbeknowest to him somebody has sprayed a section of the floor with a slick chemical. He has no warning of this whatsoever.
3) Guy falls ruining his clothes and hurting himself.
4) Guy figures that walmart owes him money to cover purchase of new equal clothes and medical bills only.
5) People on AT think he's whining.

Oh well, I guess I shouldn't have expected any better from some of you

- An assistant manager showed up and took down my name and number and supposedly filed an electronic accident report.

- He also arranged to have my clothing replaced with in store items of lesser value that are probably made in China.

- They gave me a new pair of pants and a shirt. I later discovered that my expensive leather jacket was discolored from the cleaning chemical. I have since purchased a replacement jacket myself. $200
By the very connotations evident in your post, "supposedly" filed an electronic accident report", "probably made in China", etc. it seems you had an axe to grind with Walmart long before your "allegedly accidental" slip and fall. They took a report, gave you some free clothes, referred you to a claims person for further damages. What more are you expecting, for one of them to come suck your dick?

The cleaning crew probably didn't think informing you of their presence was necessary since you didn't appear to be a blind and deaf mute who wouldn't notice a cleaning crew going to work several feet away. Sh-t happens, but I'm sure you're perfect, though, so we need not ask whether you've ever made a mistake.

I had the opposite experiance. I was wlaking down an lsle, in a hurry, while this lady was restocking the vitamin shevles. I stepped on a pill bottle and fell backwards and my hand hit an exacto knife laying on the groud and required 4 stiches. They bandaged me up and the manager took me to quick care. They did'nt pay at the quick care but after my insurance co contacted thier claims department they agreed. Nice company if you ask me. And no i did'nt sue since it was my fault. I have all the claims dept department phones if you want,.

Sounds like you've been on the internet too long. You seem to have lost the ability to think rationally. I hope nothing bad ever happens to you, you sound poorly prepared to handle it.
