This is exactly what the criminals want. Get rid of all the citizens with guns, then they won't fire back. The pro gun control crowd will claim that's not the case, but history proves them otherwise. The first modern gun control law was created by a former thug criminal turned politician lobbied by his thug criminal friends to get guns out of citizens hands because they were getting worried about getting shot. Big Tim Sullivan what a scum bag. Just like welfare + HUD and abortions for all were pushed by racists.

No big deal. Either this gets thrown out early or like the victim said... he will just file a countersuit. Sucks that he even has to waste his energy in doing that... but until it is legal to shoot scummy lawyers... it is what it is.

Do we have all the facts here or just he said he said? But is this crap about scum bad attorneys, as the US proud legal doctrines assert even scum bags are entitled to legal representation.

But still if I am correct, by all castle law doctrines, the chances of the burglar prevaling in a court of law civil suit is somewhere between slim and none. And will hopefully be thrown out as frivolous by the judge because our homeowner seemingly meets all the legal tests of the castle doctrine.

As for the criminal probable case against our home burglar, I can only foresee a long prison term if the facts are correct.

I wondered what kind of fucked up state would allow this...then saw California.

The main reason for castle doctrine and SYG laws is to prevent this, ruining the life of the victim. I guess the old adage is true - make sure they're dead.

Note to self - that idea about keeping a weapon in the bathroom is looking more logical.

Not sure why people are quick to point out that its in CA. You can sue people for anything these days. See Apple lawsuits against Google, Samsung, etc.

Somehow the idea of spidey practicing shooting while taking a dump (can you say "double target practice") just gave me some lolz....

I can't imagine this won't just get tossed regardless.

I've got the perfect place in my private shitter, I just never cared about it as the closet is off the bathroom. But another firearm in a drawer would be nice to compliment all the others strewn around the house, ready to go.

OK. The law was abused and I agree if that was the point and there should be limitations on castle doctrine.

How about the guy in the OP? Should the person who committed the crime likewise be able to engage in egregious abuse or should both be curtailed?

Kind of reminds me of the story years ago when a thief broke into a house was going up the stairs to the bedrooms on the second floor and slipped on a toy, fell down the stairs, breaking his back.

He was able to successfully sue the home owners for his medical bills, pain and suffering due to negligence in letting their child leave a toy on one of their stair steps.

Heh, the criminal crossed the threshold of an attached garage. Good shoot. Fatal error on the attacker's part.

Once they cross the threshold, shoot to kill.

Don't want to get shot? Don't cross the threshold, because once you do I am lawfully allowed to kill you. So, just don't do it.

Why the hell do you think I keep educating you people on the law? Hopefully so you don't do something stupid and get dead. Somebody in my garage or premise = OK to shoot.

Lesson learned, DO NOT cross the threshold of another's property in most of our free states, you may get dead.

As the spidey07 stupidity only lasts as long as he invites guests with children into his house. And while spidey07 plays host to his adult friends, their curios children discover Spidey's guns, and proceed to play with them with disastrous results.

As sadly, for every responsible gun owner who uses guns for only self defense, there are two incidences of guns being found and used by clueless children.

How many threads do we need on this forum to realize that its a two edge sword to kill both the innocent and the guilty. As parents and children mistakenly shoot each other with even more frequent mistakes. Bang, shoot first and ask questions later. Oppsie, I killed my own child.

Hey fuckface. I secure all weapons before kids are around and only keep the one on me active. All in the safe, every single one.

No kids around? Still secure most of them. Thankfully my friends know firearms as they are the same way, they go rooting around my house and find a firearm, they know it's loaded and ready to fire...IF they find it. Then again, my friends wouldn't go rooting around.

But IF you come into my home without me expecting you? there is a firearm 1-2 seconds away. Lesson learned? don't cross MY threshold!

You greatly offend me with your accusations of unsafe behavior.

Pretty much reenforces everything I believe about lawyers and California. Also a prime example of why you should always make sure to kill burglars and not just wound them.
