&@#7% speeding ticket!

I mentioned this in my last thread about getting back fron Banff, but now I'm just pissed!

On my way home from Banff (just outside Swift Current), I was stuck behind 3 cars all going under 100 km/h (the limit). When I'm on the highway, I feel much more comfortable being in the front of a pack of cars. I pulled out into the passing lane (it was a split highway) and sped up to pass the cars. I then pulled back into the slow lane and was going about 105-110. I look in my mirror and there is a cop there pulling me over.

I got clocked at 129 WHILE I WAS PASSING! (Btw, the limit in MPH is 62 and I was going 80)

I find out that the only way to appeal is to show up at court in Swift Current which is 9 hours away!!! The ticket is only $115, but I also get 2 demerits on my licence! I'd have to spend like $100 in gas just getting to and from Swift Current!

&(@*@^ this pisses me off!
 
Pay to have a lawyer appear in court for you.

If you have to pay $100 in gas to go, you might as well pay a little more & possibly get off entirely.

The cost of the ticket isn't what bothers me, its the 2 demerits. I don't have any other tickets or anything on my record so it would take me 2 years to clear this off my record. I'm a safe driver and I got nailed for something stupid.
 
stefan, you should point out that the fine is in canadian dollars... 🙂
I think u're screwed... lets see points against you:
1. Male
2. College kid
3. speeding
4. passing more than one car at a time. (that's illegal in itself)

Nah man, j/k! Itsucks that your appeal is 9 HRS AWAY! DAMN! For me, I'm just going to pay it through mail and attend traffic school. Officer was nice enough not to write me up for not carrying my driver license, check my car since it looks like it was stolen, write me up for my knife I was carrying and not writing up a double fine ticket since I sped in a construction zone. WOW! What a list.

Wait a sec... you are from Manitoba with a Manitoba issued license, right?

If the laws there are the same as Ontario, they (Saskatchewan police) can give you a ticket, but they can't issue demerit points because you are from out of province. I would look in to this, as you said you only care about the points, and not the money.
 
welp, better start packin yer lunch the night before the big day.. damn tickets come back to haunt you. Few years back, I gotta ticket for doing 90-100 in Montana when there was NO SPEED LIMIT, in the middle of a sunny day with a stretch of road ahead of me for about 2-3 miles. They only fined me $50, but that translated into high insurance for me. I was going there for a job interview (from Oregon) and the court session was 2 weeks later. Yeah, it sucks. But the bright side is that it'll be off my record in March. Woohoo!

definately not a good move...
and when you goto court, don't tell them you were passing because you were uncomfortable with bein 'in the pack'.

I mean, you were SPEEDING!!! of course you were passing... how could you speed and not pass? and as a result of speeding, you'll be in front of 'the pack'.

He may have a point. With the exeception of Ontario (possibly Quebec) any tickets a New York driver gets out of state have no points so long as the driver pays the fine. So if I go down to NJ and get clocked doing 75 in a 55, I'll probably choke on the fine, but so long as I pay it I don't get any points on my License.
If it's legal in your territory a radar detector can't hurt. Odds are you'd have picked up the officer before you made your move to pass.

As for a lawyer, where I live one can be had for about $150ish US.
 
I thought radar only clocked the closest vehicle, maybe you should ask to see the video. BTW i got a $425 ticket for throwing a rock out the window... (littering) best of luck
