4850 Vista64 Problems

I recently purchased an Asus 4850 to replace my previous 8800gts 640mb graphics card. I expected a small increase in performance even though i had overclocked the gts. I installed the 8.9 drivers and i experienced that the performance was worse in ati tools fur benchmark and in crysis. The weird thing is that in the ati tool benchmark the fps fluctuates a lot. It will be at 1050 fps (were it should be) but it keeps dropping down to around 930 which is less than my gts did. Temp is not the problem, I have done the fan fix through rivatuner since i have tried combonations of not installing ccc and just the drivers. Should i return the (faulty?) card or wait around for new drivers?
 
Benchmarks aren't perfect, and of course they fluctuate. I don't understand what you've seen it do that makes you believe it's actually faulty? If it's running games, most stores will charge you when they discover it's in working order.

 
You dropped in performance after you installed new drivers? That doesn't mean the card is faulty, bench on different drivers and see how it turns out.
 
Crysis favors Nvida cards, hands down. Fur bench mark has been hit or miss with the new ATI drivers,

BUT, there are cases where the opposite is true especially when you start to crank up the AA... it really depends on what you bought the card for.
