360 scratching disc ?

I picked up an Xbox 360 for my son about a month ago, Pro model 60GB HD. Halo 3 was damaged and my son thought he may have bumped it while running/playing. Now another game, Gears of War, is damaged. He claims to just have left the game in the unit and shut it down. The scratch is about 3/4 the way aroung and looks like the read head rubbing on the disc while spinning. The unit is used and stored horizontaly. Is he shutting down wrong ? I thought the games should be removed before shutting down, he says "Do you pull a game out of your computer before shutting down ?" I do not.

Isn't the 60GB models the newer released ones?😕 Maybe he just pulled a bad egg out of the bunch.
 
The 360 WILL scratch discs if you move the console during operation. If it's scratching discs when you're not touching it, then send it in for repair.
 
I guess I will have to watch and see if the unit is moved at all when shutting down or changing discs. The unit was made 7-18-08, so it's a new xbox. Thanks for the tips.
