3 speeding tickets in 4 months...

If your speedometer isn't accurate, that's a mechanical defect...and you should get that fixed.

And you might be able to argue your tickets in court if you can provide proof that your speedo was inaccurate. A judge may give you mercy, especially since your tickets (at least one of them) is for such minor speeding infractions.

a ticket for 35 in a 30 is pretty nuts in my opinion.

Speeding gets tickets. Thats why its called a speed limit. Cant afford the ticket? Simple, don't speed. Follow the speed limit exactly as posted even if traffic is going faster. Be that D bag going 70 in a 70. In the middle lane.

The problem with this plan is that depending on where you are there isn't a middle lane. Lots of freeway miles are two lanes in CA, (I-5, 101). I-5 runs, 80-85 in the fast lane, or 65 in the "slow lane" Going 70, you are going to screw things up. You will spend your life mostly trying to jump into the fast lane to pass trucks, or getting passed by trucks.

Damn dude. I could see if you were 16-17 and got two in a few months, but freaking 3 in 4 months at almost age 30? That must just be some terribly bad luck.

I don't know about CA but I can't see how they could go any slower on the freeway then the people outside of Detroit here that go 75-80 mph. And people here say it's generally safe going 10 over (80 mph) on most of the freeways.

How much over were you going, especially teh 2nd and 3rd ones?

Either way though, after the 1st ticket I'd not exceed 5 over and after the 2nd I'd not exceed it at all for as long as possible.

I think the thing is, at least around Los Angeles that I've noticed, people routinely go only the speed limit or under, even in the #1 lane. Maybe the CHP nazis have everyone scared shitless, especially the illegals without a license?

Sometimes I will be just cruising at 65mph and flying past half these jokers. If you go 70-75mph, you'll be an instant target.

I got a ticket going 75mph in 70mph on I5 past Redding, CA. Clear sky, no one on the road, driving minivan. CHP plane clocked me and radioed a cruiser to get me. Tried to appeal using written declaration, still found guilty. $350+ fine.

Wow.. 350 fine for 5 over? I did 95 in a 70 on 101 around King City and got a $350 fine.

Yeah, it was dumb, I don't need more reminders.

If I prove that my speedometer was defective when the officer stopped me for speeding, will the court dismiss the ticket?

No. The court might consider it a mitigating circumstance, but it's likely you will still be found guilty. Virginia courts will consider a defense of a defective speedometer.

I got a speeding ticket in Idaho many, many years ago. My boss had just put new tires on the truck...and they were slightly larger than the ones on the truck. I was stopped for 65 in a 55, even though according to the speedometer, I had never even hit 55 in that POS truck...🙄
I scheduled it for court...and was promptly informed by the judge that Idaho, like MOST states, doesn't require a speedometer. You are required to obey the speed limits...how you do it is up to you.
She fined me $12.50 court costs.

Defective speedometer MIGHT be a valid defense...but look at it from the POV of the court...How many people do you think try to claim "Oh, my speedometer must have been off?"
Unless you have the speedometer tested at a certified shop, I think you'll get laughed out of court...and fined.

That's why I said if you can provide proof.

It might not ultimately be worth it, but if the OP is getting pulled over a lot for small speeding tickets, he may want to see if his speedo is out of whack.

It might be worth it from an informational perspective...but I doubt it will matter in court.
Again, defective speedometer is usually NOT a valid defense for speeding tickets...but it MIGHT be enough to get the judge to give him a break.

Might be his bumper stickers.

that also gets you a ticket, for obstructing traffic.

I think from now on we should default to asking for pics. I don't trust people when they talk about speeding. Its always "just a few over" or "only 5mph over", which in my experience, translates to 15-25 over. I've seen people claim that because a road should be 75mph speed limit that them doing 80 was just 5 over, when they got a ticket for 25 over.

Not saying there aren't places where the police are ridiculous. Supposedly the neighboring county was handing out tickets for 1mph over the limit.

it's really weird, check your speed meter more often.

After years of driving, you should be able to detect if you're going too fast just by looking outside your car.

CA traffic fines are asinine. For reference, up here 25 over is ~$206 unless you're in a 65mph zone, then it's ~$360.

Sigh, it wasn't always like this in CA. My first ticket at 17 in 2001 was listed as 15mph over. Cost a now laughable $87.

The problem with California traffic fines is that SOME counties may be allowed to tack on "some extra" to the state mandated fines.

Here's the 2011 bail and fine schedule:
http://www.courts.ca.gov/documents/2011_jcbail.pdf

If you notice, 25 over carries a $280 total fine. Not THAT terrible...but enough to get your attention if you get that ticket...
Of course, California has "enhanced fines" for construction areas and "speed enhancement zones" where the fines may be doubled...

ah, the holier than thou's.

FYI, in california FWY's, the posted speed limit is 65. the fast lane is regularly between 75-85. unless there's obstructive traffic, the slow lane is going at a minimum 70.

CHP are generally fairly lax, apparently op has bad luck.

i was going 85 on my way home from LA to SD, got passed by a cop going 100+. (no lights/sirens) but it's common to see chp on freeway with everyone around him going 70-75..

35 in a 30 zone, op has a right to be pissed.

No, the law is the law and that is what cruise control is for.

It engages at 30 mph use it or lose it.

You should have your license revoked. Any authorities on here?

TTB (Tail, Tag and Bag) this guy immediately.

Me, too, but you have to realize surely they can't be real. Think in your personal life how many people do you know who never speed? When you drive to work how many people actually go at or below the speed limit? I would guess that in general 99% (really) speed at least a little bit when they take a typical drive but you open a thread like this and it's like 1/3rd of the people pretending they don't do it.

Very very few. Probably only a handful and when it comes to my friends who ride motorcycles forgetaboutit...that number is zero.

It's easy to sit behind your keyboard and point a microscope at someone else's behavior and conveniently forget about all the mistakes you've made in your own life though. It is the ATOT way.

Check out fine in Virginia .. they are very bad, especially for more than 20MPH over or more than 80MPH

Speeding Ticket Fines
Virginia is serious about curbing speed violations in the State and has introduced speeding fines that can top $3,000. More accurately, these are the fines imposed for speeding plus any reckless driving felony/misdemeanor violations you also incur.

Typically, a driver will pay $5.00 for every mph he or she is driving over the speed limit plus court fees of $62.00. Add to that the new civil penalties for Reckless Driving and you are looking at a tremendous fine! Additionally, these civil remedial fees are not one-time payments. You will be put on a scheduled payment plan where you will owe the specified amount annually:

  • 3-Point Demerit Violations at $5.00 for every mph over the posted speed limit:
Speeding 1-9 mph above the posted speed limit

  • 4-Point Demerit Violations at $5.00 for every mph over the posted speed limit:
Speeding 10-14 mph above the posted speed limit
Speeding 15-19 mph above the posted speed limit
Speeding 10-19 mph above the posted speed limit

  • 6-Point Demerit Violations at $5.00 for every mph over the posted speed limit plus all civil remedial fees:
Reckless driving - speeding in excess of 80 mph – Misdemeanor - $350.00 for each of the following 3 years
Reckless driving - speeding in excess of 80 mph – Felony - $1000.00 for each of the following 3 years
Reckless driving - speeding 20 mph or more above the posted speed limit – Misdemeanor - $350.00 for each of the following 3 years
Reckless driving - speeding 20 mph or more above the posted speed limit – Felony - $1000.00 for each of the following 3 years
Reckless driving - driving too fast for conditions – Misdemeanor - $350.00 for each of the following 3 years
Reckless driving - driving too fast for conditions – Felony - $1000.00 for each of the following 3 years

As you can see, the harshest civil remedial fee when added to the regular fees assessed when you are issued a reckless driving – speeding in excess of 80 mph ticket will cost you $3,000 + $400 (80 x $5) + $62 (court fees) = $3,462.00. It is likely that you will have your Virginia license suspended and spend some time in jail, too.

Oh shut up. You're a pathological liar, and nowhere in IL will they revoke or suspend a license for three speeding incidents under 10 mph over.

Where is "here?" Your imagination?

Oh shut up. You're a pathological liar, and nowhere in IL will they revoke or suspend a license for three speeding incidents under 10 mph over.

actually he is right..

for 3 speeding tickets in a year you lose it for a year.

hmm seems they changed it. we never had points until recently.

http://www.dmv.org/il-illinois/point-system.php

Penalties

Three convictions for traffic violations within a 12-month period can result in the revocation or suspension of your driving privilege. How long this revocation or suspension lasts depends on the number of points you have accumulated against your license.

either way he is right. it used to be 3 speeding tickets you lost it for a year.

edit: read more on it LOL

the lowest points you get for a speeding ticket is 5 points.

at 15 points you lose it for 2 months!

woot so they changed it.

YIKES.... I wonder if West Virginia is the same... I may have to rethink what I thought about a trooper..........
A few years ago.... I was driving to Tennesse through West Virginia.
Two Harleys in the back of my Pick-up. I crested a HILL... Coming up the hill, he is coming at me in the oncoming traffic lane. 3 seconds in bubblegum lights go on.... he does a bat turn across the median and pulls me over.
I asume the position... Hands on dash... Wait.
He comes over.
"Morning sir. Do you know why I stopped you?"
No sir, I dont. I know I was goinng a little fast but didnt think that fast.
I looked at my speedo when I crested. It was a Dodge dakota 6 cylinder and that puppy was STRAINING goin up the hill... When I crested gravity brought me to 80 (I was tring to do 75 in a 70).
He said I was doing 90. I kept my cool and said officer, with all due respect, this little truck with that load couldnt do 90. I did notice I was doing 81 or so after I crested.
I wouldnt lie to you on Sunday Morning... That was his reply.

OK fine.. Go on. He comes back, gives me my present and tells me he did me a BIG favor. Wrote me up for 79. 79 was STILL a 185 dollar hit so the whole time I am thinking.... Favor my ass....

BUT, I admited to 81.... So Whatever.

READING THIS....Thank you officer... 79 is FINE....................................

Ya learn something new every day.....

Good news guys. The chp was a moron and put that the speed limit was 25. Too bad the sign is about 20 feet away from where she was and it clearly says 30. So i'll be going to court on this one since it's in my home town. I know all my fans will be wishing me luck.
