$21,000 for NOTHING

I have a friend that operates a dialup/wireless ISP in Texas. Just over 2 years ago, he signed a 2-year contract with his city to provide T1 access to the library with $21k up front. The city never paid up. Fast forward 2 years - the City Manager has now been arrested for embezzling funds (He'd sign minor contracts like this and make the checks out to himself) and his assets liquidated for the purpose of paying off all these outstanding contracts.

So, my friend gets a check today for twenty-one thousand dollars. Since the contract explicitly stated that the service would terminate 45 days ago, he doesn't have to do ANYTHING except deposit the check.

How's THAT for a sweet deal?

He's gonna try to cash it in for singles, by the way.

At least in the end he didn't get burned too bad.

Sucks for the library.... now kiddies wont have anywhere to go and look at their pr0n!

I got the impression that because the city didn't pay the money up front, his friend just never provided the service.

Didnt he provide T1 service to this library for the past 2 years?

If i were him, I'd have cancelled their service after 90 days.

With the contract being there, the city was probably liable for the whole amount.

I'm a little amazed it costs that much for just a T1 to a building. I could see it costing that much if you had to wire the whole thing for ethernet. But just for the T1 it couldn't be that much could it?

Wouldnt this mean that he would have to pay in the first place, meaning that since he didnt pay, there was no service?

Nope, payment was due before any work would be done.

So he got paid for a service he never provided? That is dumb. How long do you think it will take before the city catches on?

Well, T1's certainly can run that high through some companies. You'd think you could shop around and get a little better deal though...

who knows. the goverment is pretty slow at times.

but then this is money they are out. they will probably find out pretty fast.

sounds questionable. since they didnt pay up front your friend didnt do the work. Why would the city pay him then? If its a mistake (i think it is) he should not spend a dime of that money and keep it for when they come looking for it. Or they could just make him do the work now.

I got $10,000 in the mail yesterday😀

1/2 of a settlement. Bought my daughter some nice stuff for her birthday today.

yeah even though there was a contract it still dont mean he can keep the money.

he didnt provide services so he shouldnt get paid. wouldnt be shocked if the city/state came after him for the money.
