1st DUI should = license lost forever.
2nd DUI should = forced castration.
3rd DUI should = death penalty.
1st = lose license for a year (everyone makes a few mistakes in life)
2nd = forced sterilization (male or female doesn't matter)
3rd = death penalty then burred with a pig so you don't go to heaven
Vehicular manslaughter while also DUI should = death penaly

I didn't read the article but did he get life in prison? !
He'll probably sue the victim's extended family because the murder sometimes leaves him feeling emotionally distressed.

honestly i dont understand DUI + crash.

me and most of the people i know have driven drunk, high or stoned and have never had/caused as much as a scratch to person or property.*

Why are people talking about sterilization as a punishment for DUI? DUI isn't hereditary and isn't a sexual crime. Talk about cruel and unusual.

They are rich huh, sounds like a civil lawsuit to be brought to them.

According to the judge, the affluenza caused the wreck. I say divide their wealth into quarters and send it to the families of the dead. 2 birds with 1 stone.

That it being errornouisly reported. The defense used that argument, she did NOT use that reasoning in her sentencing.

The lawyer argued that he didn't know right from wrong. How will probation teach him anything?
What does the judge do if it happens again, or a similar situation arises?

Does the layer just argue that the last sentence didn't teach him right from wrong and then he gets probation for another 10 years?

Seems counter intuitive.

However prison isn't the answer. Community service or rehab as was suggested by the doctor seems fitting. Maybe a combination.

The judge is supposed to be retiring next year so she sentenced the kid on her way out.

I wonder how much money the kid's parents have? I also wonder if the light sentence will lead to larger awards during the wrongful death lawsuits to follow.

It's sad they actually had to come out and say this:

‘Affluenza’ defence in Texas teen’s drunk driving case rejected by psychiatric group

“Affluenza,” the affliction cited by a psychologist to argue that a North Texas teenager from a wealthy family should not be sent to prison for killing four pedestrians while driving drunk, is not a recognized diagnosis and should not be used to justify bad behaviour, experts said Thursday.

I remember a story awhile back where a guy from China was in the US and raped a girl. He tried to bribe her and that didn't work. His parents came over and kept trying to bribe but still no luck.

They didn't understand that you don't just bribe somebody over here. You've got to have a show trial and then civil suit.
There was a case in Canada a few years back where a Chinese guy stabbed his Chinese wife. The judge gave a very lenient sentence citing differences in cultures in different ethnic groups.

Of course, EVERYONE called the judge a moron, including the Chinese community.

You must be a huge douchebag. It has been shown that being drunk dulls reaction time, peripheral vision, depth perception, etc. Just because you haven't yet wrecked your car driving drunk, doesn't mean you're immune and can drive drunk.

just a thought, maybe sterilization means a decrease in alcoholics==decrease in people who drink and drive with a blood alcohol level > legal limit.

There's a hereditary predisposition towards alcoholism. That doesn't make alcoholism itself hereditary, much less does it make inclination towards DUI. I know someone who has never had alcohol in her life because of her mother's alcoholism, in this case the odds of her ever becoming an alcoholic are substantially lower than whatever the average for the population is. I think the title of this article is bogus, you don't inherit alcohol abuse from your parents unless your parents force you to abuse alcohol.

This really reminds me of my first run in with the police.

A few years ago I was involved in a motorcycle accident ( not my fault ), but did not have a motorcycle endorsement on my license. I had attended the MSF class and taken the test, just not had it stamped on my license.

I had to go to my first traffic court. Didn't think too much about it, knew I would have to pay court fee or whatever, but no big deal.

They made us watch videos and handed out mandatory sentencing cards and then the judge entered. First guy went to the podium and got hit with a suspended license. Driver stated he didn't know it was suspended and had never been notified it was suspended. Judge stated it wasn't the states requirement to even notify him that his license was suspended due to being able to keep up with child support, and sentenced him to 60 days in jail!! Just sitting in that court room with about 70 people and hearing those handcuffs click was terrifying. The guy cried and said he was working 7 days a week to try to pay and asked how he was supposed to pay child support if he was in jail, judge said it wasn't his issue and the baliff removed the guy.

My legs were trembling. Guy after guy got up there for suspended license, minimum time was 30 days in jail. I texted my wife and told her to get ready to bail me out soon at this rate.

Half way through the people, I saw approx. 10 people get jail time, multiple people get hit with $2500+ fines for various things, and then a young girl approached the stand.

Girl was 17 and this was her 4th DUI, and this time she was charged with serious bodily injury which was considered a felony. I knew this girl was about to get life in prison with this judge!! Girl was in tears, saying she was sorry and was flanked by 3 lawyers. None of the lawyers really said anything, they just stood there looking important. Judge read out that this was her 4th DUI, this one involving serious bodily injury, multiple arrests for drugs and shoplifting...and then the judge was about to announce her sentence the lawyer stated that she just didn't know any better and needed counseling.

Judge didn't even get her probation, 1 month of weekly counseling ( 4 sessions ) and 20 hours of community service!!

1 dude in the courtroom heard this and said out loud, probably not meaning to be disrespectful as he didn't yell it. "What the #@#$", right then and there that dude was arrested for contempt and sentenced to 30 days in jail!!!

Everyone is correct in this case, money buys your way out of anything and laws will never be applied equally. So very sad.

Don't leave us hanging, what happened to you? Also, if you are sentenced, you can't "bail" yourself out. Go directly to jail.

Just like politicians.

Two tiered justice system removes the incentive for the rich to have any moral guidelines when they want to behave badly (i.e. Cheat or kill other non rich people).

Good old USA, standard stuff here though unfortunately.

Yes, it's an inherited predisposition to alcoholism..

If you friend NEVER touches alcohol, then she has 0% chance of becoming an alcoholic. If she drinks alcohol, her chances of becoming an alcoholic (or abusing alcohol, and assuming she's inherited the predisposition to alcoholism) are higher compared to someone else who doesn't have the same predisposition.

The topic of sterilization is where this began. I have no stance on it because I've never thought about it. I was just trying to shed some light on why people may hold this stance.

In terms of number of alcoholics who are drunk drivers compared to non-alcoholic drunk drivers, I'd be curious to see what the numbers are. If I had to guess, it would be that alcoholics are much more likely to be repetitive offenders

Vehicular manslaughter while also DUI should = death penalty.

Driving w/o a license should = mandatory 1 year in prison, no eligibility for parole.

There is no excuse for this type of behavior, and it needs to be punished more heavily. I once worked with a guy who had 5 DUIs. FIVE DUIS! Clearly he has no self control and no common sense, and we should rid the gene pool of his taint.

I hear Saudi Arabia and/or Iran are rather nice this time of year....

Anyway, Couch will be sent to a “small, private home in California which offers intensive one-on-one therapy,” which should do wonders for a kid who wasn’t punished by his parents when “police ticketed the then-15-year-old when he was found in a parked pickup with a passed out, undressed, 14-year-old girl.”

I take back what I said: he’s Joffrey by way of This Is the End Michael Cera.

Apparently this is not the first time he's been busted and gotten away scratch free. That last sentence is the most accurate thing I've heard yet, he is the modern day Joffrey. Hopefully he meets the same fate :awe:

WTF... was this trial by jury? Did they rig the jury?

I see it is just the judge's decision. I say there should be a probe into the judge's finances. Have NSA handle it.
