Hard to say who's at fault. Says the inspector deemed the site safe even after complaints. On the other hand, operator tested positive for drugs. Either way, sad ending.

why was the crane oiperator held w/o bail?
he volunteerily turned himself in

IDK, but perhaps it is because he is a convicted felon with known aliases and they thought he might skip on the murder charges?

How the heck can you operate heavy equipment with a rap sheet like that, including drug offenses? Heck, places like Home Depot wouldn't even hire you, simply because you might end up running a forklift.

It's demolition work, I imagine the customer just takes the lowest bid every time. That's how you end up with the least desirable workers.
