I seriously doubt that Dell or WD made this mistake on purpose. Most of Dell's e-biz site is generated automatically out of a database somewhere. The number of "holy cow" deals that pop up (e.g. Home coupons that magically work in the SB store) and disappear in short order is pretty good proof...

BigdaddyF is correct. Anyone living here in VA (and PA, MD, WV, NC, FL, and many other states) should be paying their "consumer's use tax" on out-of-state Internet purchases anyway. You're all paying that every year with your state income tax, right? :D
