Even though those options aren't vested, they have value to them. There has to be some legal precedence if the employees get fired for any reason. Otherwise it seems like a gaping loophole where an employer could simply hire talent and pay with options and fire them the day before they're vested.

If the CEO is so worried about it, the right way to do it is to buy out/close the option positions at current market value.

Were I an employee there I would tell the CEO to kiss my dick. If they fired me I'd drive straight to an attorney's office.
