If it's active on an existing Computer (meaning the Key), then no, you can't legally sell it.
As far as reactivating it, if the existing System has registered it with MS, then I doubt you'd be able to activate it on another System.

It's possible to just buy a License and then use that Key with the Software though.

well, i'm in the process of installing xp pro on the original machine. so there wouldn't be 2 machines using this license.

wouldn't it be possible (if a problem with activation arises) to simply call and say you changed hardware?

If you're putting XP pro on with a new Key, then my understanding is that you should be able to transfer the old Key with the Software.

Unless MS has changed things again, you'll have to call them to activate ANY new install/reinstall because they deactivated that feature some months back. You'll an extremely long line of numbers that you'll have to give them, and then they'll give you a bunch of new numbers to enter for activation - a real pain.

I've had to do this when reformatting my Computers a couple of times, just let them know you're reformatting and you should be fine.

This is enough info to answer your question from the "what's legal?" angle. It's OEM, and it's been used once, so now by the terms of the EULA, that license goes with that hardware forevar. Also, the shop is required to stick the sticker to the case for the license to be valid, as dumb as that may seem to those of us who sometimes buy new cases

You as the license holder can transfer the OEM software with the system it came with, if you want to, but it sounds like you're keeping the hardware.

well then. i guess i'll have to test this out on my test rig then. if it activates with no problems then i'll get rid of it.

thanks for your input.

????? What, so if I purchase XP then put it onto a computer, then format the computer, I need to call them and ask them to "OK" it?

That is SO lame!

You can't legally sell it separately, and no one who buys it has bought a valid license to use the OS either. They might as well use a keygen and save themselves time and money, as buy an invalid license from you.

Yes, you might need to call for a reactivation. I did, despite it being a retail WinXP (not OEM) and being on the same machine as before.
That is SO lame!
Thank the pirates for bringing this stupidity down upon us.

a keygen? then they'd have to download the whole cd as well.
