yet another traffic violation thread

does anyone know if city police can ticket you for a traffic violation that occured on private property? My mom has already had the ticket so I am just curious.

Basically what happened was there was a stop sign on private property and a sign that said no left turn. Neither sign is a government sign, just a sign made by the private property owner. My mom made a left and was given a ticket by city police. I just don't see how the police can ticket someone on private property like this when it isn't a government traffic sign.

This was a Walmart parking lot. Don't talk out of your ass 😉

EDIT: The reason I am asking is because a county cop that lives behind us said he didn't think they had any jurisdition to ticket my mom.

So, she's allowed to do whatever she wants in a walmart parking lot? She can drive 75 MPH through the parking lot if she wants, cause it's private property?

Jesus f'ing christ. Just exit the thread if you can't answer my question.

EDIT: I guess you are perfect and everything. My mom paid the fine and i am just curious.

On "real" private property, like a large lot of farmland, they can't do dick. Guy I knew had a drunk driving accident and they couldn't do anything because of that. Don't think its the same for a Walmart parking lot. The cops can arrest you in the store so I don't imagine it would make a diff if you were in the parking lot.

oh, hehe. i was going to ask why that cop was on your property. 🙂 i'm not really sure how that works at Walmart.. i tend to run those stop signs if no one's around myself (especially at the mall, they're ALL OVER). i sort of use the same reasoning you are.. can't get ticketed on private property. guess that pretty much proves me wrong!

what a fvckin dope.. doesn't that cop have anything better to do than pulling people over in Walmart parking lots? ah well, typical.

Well in Walmart to arrest you, Walmart would have to press charges which didn't happen. Thanks for the reply 🙂 This is why i am curious

If it is in fact private property, and you have permission from the property owner, I beleive you can typically drive however you want on the land.

This may not apply to parking lots, or other public places of business. The government does have a certain level of control over parking lots. See all those handcapped spots up front? know why they're there? The police may very well have the right to ticket you for violating psoted traffic rules in a parking lot full of pedestrians. Hell, the city might own the land and lease it to walmart.

they can arrest you for shoplifting, etc. minor traffic violations? i dunno. maybe the difference between the lot of farmland and Walmart is that Walmart is public.

This walmart has been there for 10 years and my mom has been going there for that long. It was a new sign Walmart put up and the cop pulled around 30 people and the judge didn't give any breaks on it.

I understand where you are coming from but the handicap signs ARE government signs. This "traffic" sign wasn't. As for the city owning the property is very possible. It isn't like my mom is trying to get off. She just told me about it and it sparked my curiousity

Shoplifting is totally different simply because Walmart has to press charges to have someone arrested which is different from a traffic violation.

ahhh this is making more sense now. Walmart put in a new stop sign, people were ignoring it, cops started enforcing it. for all we know, Walmart might have reported the problem to the cops to begin with.

Actually it wasn't the stop sign that was new. It was the no left turn sign. My mom made an illegal left turn but stopped at the stop sign. I had a good laugh at her expense 🙂

How do you know walmart put in the stop sign and not some government agency?

Government signs are metal not wooden. Trust me it wasn't a government sign.

Alright, get this one...apparently since my neighbor owns both sides of the road (yes, it's a town road, paved by the town, plowed by the town, etc.), he can block it all he wants.

We had an incident this summer where our neighbor parked his hay wagon accross the road and guarded it with a shotgun threatening anyone who tried to pass. We called the cops & they said that he had the right to do that. It took us 3 weeks to get back into town (that was the only road in/out that my car would pass) by vehicle.

Well I'm @ school now, so it's no issue to me. The lawyers are still fighting over weather it's legal for him to do this or not, but in the mean time we've just been parking our cars at a friends house & using ATV's/Snowmobiles to get in/out.

Walmart does not put up signs for the most part. They will grant permission to cops/cities wanting to place signs but walmart does not put them up themselves.
