Yet Another Taxation Question !

I asked this a couple of weeks ago but no answers. Lets try it again. I am a resident of CA but for the last more than one yr have been working out of state (TX). Last year I filled my taxes from CA. But now I have been out of CA for like 1.5yrs, still have a CA ID and never cared to get a TX ID. So this year where do I file taxes from TX or CA ? I think if you live in TX for 6 months or more you become TX resident. TX has no state tax so I can save that additional taxes which I have been paying in CA. Any opinions ?
 
If you are currently physically residing in TX, then you can file taxes from there. I assume you're talking about Fed/State/Local. The IRS has rules for residency, and the state & local will probably be the same.

When you say you reside in CA, I assume that means you have a place there, but you are physically living in TX?

When your employer pays you, what state do they have you listed as on the payroll info? Not that it matters for filing, but it makes a difference in how much tax they take out.
 
If the employer did not take out CA taxes, then ignore CA.

If they did, then you will have to file some CA paperwork. Your choice on how you wish to declare your CA taxable income.
 
Well when I initially moved down here, I had an address of CA (my uncle's address) as my perm address and paid CA taxes las year.
Till July '03 my employer had my CA address and was deducting CA taxes but now I have Texas address and hence he doesn't take any CA taxes. I guess I was listed under CA with my employer but now am under TX. But they did do CA taxes for more than 6 months. So that means do I have to file taxes from CA even though I have no income from CA ?

Just file your CA tax and adjust dates/income declaration to attempt to return what ever you can get.
Your loss due to not catching the issue when you created a TX address. 🙁
 
If you really did in fact reside in TX from Jan to Jul, you should be able to get your withholding back from CA. As it is bound to be somewhat sizeable (like 7% of your income for half the year), you really should put in the effort to getting it back. I'm sure it's just a matter of filing the right forms and provide some simple documentation (like utility bills, etc. proving residency in TX). And go get a TX ID, ok? You live in TX now.
 
Let me add one more thing here. I live in a hotel down here so practically have no permanent residence. Just receive all mail etc on that address.
