Yet Another Stupid Ebayer (Is it me?): What should I do?

I sold this guy two of these.
I "obtained" them from work from the "bad" box. When laptop battery start to suck, they buy new ones and throw them away. I take them and sell them on eBay for like $20 or so. I have sold about 15 of them in the past and now is the only time I have gotten a problem.

The dude says that my auction is "deceiving", and he wants his money back. I told him that the auction CLEARLY states "SOLD AS IS" and "I am unable to test them."

So he buys them, says that they only last 12 minutes and he wants a refund. He says that becasue we both have 100% positive feedback, he doesn't want to exchange negatives.... which I understand.

What should I do? I don't wanna just give him his money back (although I could). I mean the auction says SOLD AS IS! Ans yes, ALL 5 Lights DO light up on the battery when you press the button.

Any suggestions?

even though technically he shouldn't complain the auction is kinda misleading. you said they were thrown out because they are going bad but i see nowhere on that auction you mentioning anything about that. maybe as-in means more to a frequent ebayer but to me it could mean anything. i would leave that auction alone or at least ask the seller about it.

You did say "as is" but you're still being deceptive. You say "I am unable to test them" but you have tested them because you know that they're the ones that were rejected by someone because it died.

SOLD AS IS means there is probably something wrong with it. Those batteries go for $60 new, so an unknown status one should go for around $20. Many people need a battery just to test with, or just to fill in their empty bay. The price reflects a lot about the product.

If you are meant to sell "as is", you should put that in the auction title.

Maybe putting 'Sold As Is' in bold and not in the middle of your spiel? Not to be rude or anything, but if you're going to sell something you know isn't the best it's nice if the seller makes it easy to find. I hate sifting through ebay auctions because people like to hide the Sold as is somewhere in their write up (not saying you hid it though, just bitching ).

Caveat Emptor. Let the (dumbass illiterate) buyer beware. This is why I do this funny thing called reading the auction. If it says "as-is" I expect it not to work. Thusly, I don't bitch if it doesn't.

not implying any ebay vendors, just general. i got scammed for some speakers marked "$1999" retail. my neighbor (college kid) actually sold them to me... but it is my fault for being such a fool and buying his lines.

edit: the guy has 220+ feedback on his account he seems like he should be a seasoned ebayer I don't understand how he didn't see something like this coming.

Ooh so you're the guy that sell these batteries. I have a laptop CPx and was looking at ebay a month or so ago. Interesting. Any idea how the place you work are obtaining these new batteries?

I assume you can call Dell and ask them to send you one at outrageous prices right?

I think you are a lamer edro13. You put in clear text in your ebay listing "The battery lights up all 5 lights on the side when you press the button.
Sold As Is. I have no way of testing it." when it was proven bad somewhere else. You conveniently leave this out, as if this could possibly be a new item that just got taken out of the wrapping. Hell, you didn't even use the word "used" at any place in your auction at all.

This is deception. It isn't flat out lying, but its deception. You should send an apology out to every previous auction winner that you ran like this. And in thie apology letter you should send an offer to refund all of the final auction cost, plus refund the buyer's original shipping costs for your bunk product.

That is what I percieve is what you should really be doing, you asked our opinions and you have definitely got it here.
