Brief overview for those that did not see the previous thread.

On, or about 20 June 2001, the Internet presence site for a local newspaper was failing to connect to it's mySQL database. HostWay support was contacted and stated that they would get on matters right away and call back once the problem was remedied.

Later that evening, a call was received from HostWay that stated the Site was fully functional again. We checked the site and it appeared in working order.

The night of the 20th, we attempted to add the days news to the database and were greeted with many errors. Upon checking the database using phpMyAdmin, which is a php based mySQL front-end, we noticed quite a few garbled characters in the database. Upon further checking we saw that the user tables, editorial tables, as well as quite a few other tables were corrupted.

We contacted HostWay and requested a restoration from back-up, as they state that they make nightly backups. They asked that we drop the database, clear out the /www directory and they would preform a full restore. When asked how long the restoration would take, we were informed no more than 12 hours, and if it would take longer, they would contact us.

48 hours later, we contacted them and asked what the problem was. They stated that their backups were off-site and their sysadmin had been made aware that the restoration needed to be done. They agreed to send a second message to the admin. The phone conversation was followed up by an electronic mail message verifying all that was covered on the phone. They replied later that day by stating that they were searching for the backup and would notify us once it was complete.


Today, 06 JUL 01, HostWay support was again contacted and we were informed, oh, ever so sorry, but the data you need has been overwritten. Needless to say, I blew my top totally. They had restored the database but fully neglected to restore the /www directory that they told us to rm.

Hostway stuttered and stammered for a while and came up with the genius idea they they would offer 6 whole months of free hosting for their error. The 6 months of free hosting does not even come close to the cost that needs to be paid to a developer to re-design the front end, nor does it cover the loss-of-face experienced by the newspaper by not only their advertisers/clients, but also their customers.

Does anyone have any reccomendations of what can/should be done in this matter?

Don't they have any other backups of your data (maybe from a few weeks ago?) At least you could get your front end from it even if you lost some of the more recent data? Seems odd they only had one copy of your data. Usually you rotate a couple sets of tapes...of course if they drug their feet for this long maybe they overwrote both sets?

That aside, I would be willing to bet if you read your contract it will say they do not guarantee service or backup services. I am sure they have themselves covered for their stupidity.

Of course, if you invested significant time in software design you should have a copy of that work yourself...but I don't know the full details so I can only offer my opinions.

I would ask for monetary compensation of some sort, read your contract carefully, and then take my business somewhere with an administrator with his head on straight.

From what they are saying, all of June was wiped completely when July 1st rolled around. DOes not make sense to me as most companies work on a daily backup with a 30 day rotation...

I just read the contract, they are hitting the basic we can replace your site with a picture of &quot;Barney&quot; and there is not a damn jolly well thing you can do about it... It was odd how they got the terms of service signed though. At the billing area, where they asked for a &quot;signature&quot; to verify the charges to the card they also have in fine print (around 8 point) that you are agreeing to their terms of service that they can modify whenever they please.

The developers had given us a &quot;somewhat&quot; copy. We have a phase 1 copy, however over the months they had gone in and made updates to make the site more stream-lined, load faster, and implemented new features that are not on the phase 1 copy. They had also made fixes to some of the phase-1 code that did not work. To get the site back up to par, they would have to restore the phase-1 copy we have at the office, then we would have to pay them a small mint to get everything back to where it was before the HostWay disaster. With all our advertisers gone, as well as the loss of faith by prospective clients, we can not currently justify the costs.

They refuse monetary compensation, but have offered the grand prize of a whole 6 months free hosting. Yup, I feel that $150 worth of hosting should easily cover the cost of having the developers get back on the payroll...

Hard lesson has been learned for you. If you need backups done, do it yourself. NEVER EVER EVER NEVER EVER rely on anyone to do it for you. If you do then you are asking for trouble.

I hate to hear about this happening to you. I know that when I do software projects I keep copies of things in about 5 different places

Can you track down the firm who developed the site for you? Maybe they have a copy of it in storage.
