I unknowingly bought an inactivated xbox live gamercard (12month + 1month bonus) off ebay about a week ago. Didn't even know as the code worked fine, but when I found out about this scam and checked my account...indeed the subscription starts/ends same month.

I've filed a claim with paypal, to which he responded to my ebay message asking for a refund (he claimed to have been out of town).

Here's the last message I got:

"Can you drop the claim on paypal. IF anything comes up in the future and your not feeling like your satisfied dont feel like you cant contact me or reinstate the claim."

I said I would drop the claim once I got a refund.

I suppose there's a couple possibilities now:

a.) He refunds my money thru paypal
My question is, if I transfer it to my bank account, is there anyway he could reclaim it?

b.) Since he's messaging me thru ebay and not the paypal resource center (whatever it is called), should I quote the messages/make an additional post in the claim?


Any general advice would be much appreciated...this is first time I've gotten scammed...and the seller has done it to several other people (although now some are catching on and leaving negative feedback).

"Hey, it will say that on your account info. When the next month hits it will say expires 11/07. I can garuntee this I use this same card on my 2 accounts."

"There is no refund involved. You have a working account for 13 months. It just doesnt say it. Just check on the 1st and you will see. Paypal normally wont rule in your favor, I have to go through this quite a bit."


Anybody know anything about this? I think it's b.s. b/c I bought a a real 12month + 1 bonus from buy.com and it properly said the expiration date. I sent an e-mail to xbox360 live support as well...

Final Update

Paypal denied my claim

"Based on our definition of significantly not-as-described, this claim does
not qualify for a refund."

How paying for 13 months of a service and getting 15 days isn't "significantly not-as-described" boggles my mind.

I've never been scammed before, not a fun feeling :/


Cliffs:
1.) Bought 12month + 1 month xbox live "new user" card
2.) Friend notified me that this is a scam
3.) Check xbox live account..yep the "new user" cards are inactivated cards and expire the same month
4.) File a claim with paypal and give them oodles of info
5.) claim denied...bastages

definitely do NOT ever close a claim (Someone who tried to scam me who I found out of - I'm getting a refund - told me that how he tricks people is to have the person
close the claim so to work out an agreement)

Put all evidence into your claim since if he/you close it, theres no way to add more information

I do not believe that he can get to the money if it is in your bank account - I've been scammed before and have had negative Paypal funds but have had money in my bank account

anyways he's lying. as soon as you upgrade your live info it will automatically update it. i've done it twice and i plan to do it soon because i have 2 1month cards.

just tell him to refund you or you are going to continue through paypal to get it back that way.

EDIT:

tell him to click the "refund" button on the transaction, not just send you the same amount back.

I'd file the claim through paypal and not deal with him directly. It helps create a record that he's a scammer (or potentially a scammer.) It'll help everyone else out when they attempt to purchase from him and find themselves on the short end of a scam.

He's had two neg out of hundreds, and lots of positives involving these same cards. Honestly I wouldn't say he's a scammer for sure, have you verified with Microsoft that the card is no good?

I think this is a pretty common scam - the reason he has positive feedback is because it takes people a month to realize they've been had and have already left a positive feedback.

OP, continue with your paypal dispute until he refunds your money.

Well, I escalated the claim. Here was my final message...hope I get my money back/help some people out. Thank you for the advice.

The seller has communicated only by ebay message system. These are his messages.

1.) Of course he would like me to close this claim, because then I would have zero recourse.

2.) He gurantees that my subscription would renew itself on a monthly basis automatically. I.e. even though the begin and end date of the account are 10/07, the next month it would show the end date as 11/07. I called xbox customer support at 1-800-4MY-XBOX, my reference number is 1047906604, and they confirmed that this will never happen under any circumstances.

In summation: The seller advertised and I bought 12months + 1month bonus, so a total of 13months of xbox live service. What I received was a code that provided me with 15 days of xbox live service. did you pay him through your creditcard via paypal? if not, that was your first mistake. credit card companies will back you, and you can do a chargeback.

For the record: PAYPAL SUCKS!!!!!

I will from now on...My primary source is my bank account...2nd was my check card.

Guess it's time to change that.
