I won an auction for a new DSL modem here.

He pictures the newer 5100b model with 5 lights, but I receive it, it's the older 5100a model with 4 lights. There are functionality differences between them.

Now I emailed him and he's only offering me a refund minus shipping. I wanted a full refund.

Am I wrong for assuming it was the newer model since it was pictured even though it was not specifically listed? Should I accept a refund without shipping or try to make him refund shipping also?

File a complaint with PP. If you're right that models are totally different you will get a full refund and shipping. You will be, however, responsible for shipping charges back to the seller. On top of that, PP will require you to ship by trackable means.

The models aren't TOTALLY different but there are several functionality differences.

I think it's reasonable to conclude that you would receive a "5100b" 5-lights model as displayed in the auction. However, since it's not expressly stated so in the item description, I don't think eBay will enforce any action against the seller. In my opinion, take the refund offered by the seller and chalk it up to a lesson learned. :thumbsup::D

same happened to me with a camera case a few months back. Seller issued a full refund of my paypal amount (which is easy for them to do). So that includes shipping. I ate the shipping back to him though.

If he posted picture is not the actual product he is ok...dishonest a bit, but you should have asked.

If he didn't state that complain. A lot of sellers pull this stuff and the full refund minus the $21.50 I charged you to ship a 3 pound package ground.

It's like the rental furniture places....

5100b has PPPoE on the modem. It has a different chipset I believe (not positive), and some people reported better speeds with the 5100b than the 5100a.
