wait, what? CHP uses radar here on the 101 all the time AFAIK, since they're always sitting up on onramps watching cars go by...

It's not illegal but it is policy. People's radar detectors were going off, causing traffic jams and accidents as a result.

(all the times I've been busted for speeding in my home state (IL) I was goin at least 20 over, (thankfully they never caught me driving fast ... ) I was pretty much guaranteed NOT to win, and once in Wisconsin, was going like 15 over by the time they clocked me. again, not really a chance at winning, and i was like 3 hours away from home and did NOT want to drive back there for court or traffic school (my insurance payments hurt because of this one)



This is something I've read, I have not actually done this

fight it ... usually if you can prove you were driving within the 85th percentile speed on that stretch of read, then that would mean you were just going the speed of traffic, which would be safer than going slowwer. since the chances of getting rear ended is much more likely. Since the "purpose" of speed limits is supposed to be "safety" (though it really seems like its more of a "drivers tax" these days) then you are not guilty of anything since your motive was to drive as safely as possible by increasing your speed to match the rest of the traffic.

you should (hopefully) be able to get data about the 85th percentile speed from the tollway or highway
authority in your state.

I doubt radar or laser scanning for speeders is "illegal" in any town, city or state for any police ...

he maybe right i don't know it just the officer saw my radar detector and tod that. Going to show a ticket to a neighboor who is chp cop and will ask him the question about radar use on freeway

Well I got pull over on 405 freeway doing 78 :( the officer also gave me the verbal warning for following to closely

Btw to those that are in California, chp cannot use radars on freeway, they must follow you. Was told that by the police officer that pulled me over for speeding so what are the chances of him not showing up? Should I just do extension on the court appearance for as long as I can or should I just find out when this vacation is and prolong the extension till he is on vacation?

To those that tell me why don't I ask my lawyer, well its 11:54 pm here and it?s kind of late to wake up right now to ask him this question.

I'm not even going to read any of the replies to your post. The CHP was authorized several years ago to use radar. You lose.

first he didn't get me with a radar, second i was suprised by the officer comments as much as everyone on this board but that is what he told me and told me to fight it if i ever get busted by it.

okay thanks, btw i just checked and he followed me for 3.3 miles. Must be not my day as i did alot of change lanes and never saw a car following me :(

Regarding if the CHP can use radar on freeway the answer is not in most places. I just talk to my neighbor who happens to be CHP officer. He said the only places were they can use radar is on some part of the 14 freeway, the 15 and the 5. All other freeways the officer must follow you to determine your speed.

no plates was legal, car have been only owned for one month and 10 days and we don't have temp plates in california.
