Okay, since i know how much we all LOVE speeding ticket threads, here goes another one...
Okay, my friend got caught doing 50 in a 40. The issue in question is more about what the officer marked on the ticket. According to the little guide on the back of the ticket, he wrote my friend up for the violation of 'Speeding 30 or more miles above the posted limit' instead of 'Prima facie speed limit' (I think that's the correct term for the second one). Now while I share the general mentality of the board that if you were speeding and you get caught, suck it up and pay the ticket, does it mean anything that the officer wrote the ticket for the wrong violation?

Friend got a ticket 50 in a 40, but the officer marked the violation as 30+ over the limit. Can he use that in his defense?

He was speeding. Pay the damn fine and move on.

 
Just go to court and plead not guilty. Chances are it will be dismissed if truly only 10mph over. At the least, get traffic school, pay court costs and no points.

Exactly. A 30 over means you get points. You cannot go to traffic school for such things, unless the judge is really nice. Plus it costs a lot more money.

Both speeds should be listed on the ticket.

 
That's the thing. The officer wrote the speed as 50 in a 40, but on the part where you check what was violated ( i.e., reckless driving, breaking speed limit, etc.,) he checked the one for 30+ miles over the posted limit instead of the one for just breaking the speed limit.
 
probably just made a mistake, take it to the court have them change it and be done w/ it.
