YASTT: Got a speeding ticket, license will probbably be suspended, need advice

Well the day finally came last week, I got my first speeding ticket. I was driving to visit my grandmother and got popped doing 81 in a 65.

The thing that sucks about this is that my license is probbably going to be suspended or possibly revoked, even though this is my first speeding ticket. When I was younger my license got suspended for underage drinking and I just kept on driving. It got repeatedly suspended. I got it back, and about 3 years ago I got into an accident at a stop sign (couldn't see traffic coming from my left because of the way the intersection was laid out, crept out real slow to see before going through the intersection and some douchebag in a Montero damn near ripped off the front end of my car doing close to 50 in a 25, however it was -my- fault because I 'failed to stop'). Anyhow, I had to take that test where they give you your license back if you pass but you only get one point taken off your record.

Well, fast forward a bit and here I am. I ended up getting down to 2 points on my record through safe driving. The ticket puts me back up to 6 points, which is the cutoff in PA. I got a letter in the mail stating that I would recieve another letter about a hearing.

So Im wondering, what options do I have? I deliver pizzas for a living and I can't go without my license. If I lose my license, I lose my job, which means I lose my apartment, etc. There aren't exactly a lot of other jobs in the area, and although I've been looking for something else for around 4 months now, nothing around here will pay me the same amount (even @ 40 hrs a week) as my part-time delivery job. I know they have those licenses for people who need them to commute to work and back, but what about people who use their car like I do? Should I contact a lawyer about this?

I don't want to contest the ticket. I know I was speeding and the officer didn't even have to flash his lights at me, I pulled over as soon as I saw him pull out. I believe in being responsible for my actions, I just don't know how the hell I'm going to pay my bills if I lose my license.

Contest it.

Go to court dressed nicely. Talk to the DA and tell him your SOB story. Hopefully he will be sympathetic and reduce your ticket.

You actually have to have a hearing and all that? In Ohio, we can just pay the ticket through the website, or through snail mail. Or do you have to go to a hearing because of your previous driving record?

Yeah, I think thats why I have the hearing. I paid the ticket the day after I got it. The letter I got was to inform me that I have 6 points on my record and will need to have a hearing to determine if my license will be suspended/revoked or not.

Sorry, but that's just idiotic in my opinion. You shoulda ALWAYS contest, not because you didn't do it, but because contesting it gives you a chance to come out on top. If you think like that, you deserve to get your license taken away.

I would hire a traffic lawyer if you can't figure out a way to defend yourself.

Just tell them that based on your prior experience, it doesn't matter to you whether your license is suspended, you'll just keep driving anyway.

looks like u will need a lawyer. call one up and talk to them... they should know better then anyone on ATOT... unless of course we have some PA prosecuters here.

I also agree on the contesting part..

I've taken two tickets to court where I was speeding both times. The first one, the cop never showed and the ticket was removed.

The second, I argued for a long time and they took all points off and reduced the fine - but I still had to pay it.

You want advice...STOP SPEEDING. You should have thought of that before speeding and having your licence taken away. If you really believed in taking responsibility for your actions, you would accept that losing your licence is your punishment. You should learn to think ahead.

I did not think that I would have my license revoked for doing 81 in a 65, especially when the flow of traffic was moving around 75 mph. Furthermore, I doubt you do the exact speed limit everywhere you go, so get down off your self-righteous high horse. If you don't have anything constructive to add, then kindly stfu and go crap in someone elses thread.

I think it depends on the judge.

When I was 18, I went to traffic court to contest a "following too close -> Accident" ticket. The lady right before me was charged with reckless driving for doing 85 in a 65. The woman argued and lost, and then she started sobbing and pleading for the judge not to take her license. Saying how she'd lose her job, her home, not be able to take care of her baby, etc.

The judge's reponse: "You should have thought of that before you drove recklessly. I sentence you to 30 days suspended license." :Q

I figured I was screwed! Thinking I had nothing to lose, I plead guilty on the spot and threw myself on the mercy of the court. Instead of throwing the book at me, he let me goto driving school instead of paying a fine/losing license.

Good luck, I hope you get up getting treated like I did and not like that poor woman did!

or the other punishment of paying a lawyer a ridiculous amount to save ur license. it's gonna hurt either way.

Well I'd try and contest it and admit to the judge that you were speeding and you're willing to pay a price for it (it's a good attitude and would help), but that you absolutely need your car for pizza and over the last several years you've been trying your best - and doing a decent job - of correcting your driving past. Tell him you need your license and what else can he do to penalize you in a non-suspension sort of way.

Yes, it definitely depends on the judge. I remember when I went to court to plead my driving ticket. It wasn't to contest the actual ticket but to ask the judge if he'd let me go to traffic school (you can only go every 18 months in CA, it had been 17 months and 20 days for me). In any case, the judge I had was very nice to everyone. He reduced the fines of everyone that was pleading be it drug charges, traffic violations, etc etc.

I think since you will be paying some moola either way, you'd be better of hiring a lawyer.
Call around for a lawyer. I think they usually willing to hear your case before quoting you the fee.
The judge will not sympathize with you if he sees your driving history.
Since having a driver license is your lifelihood then fight for it.
Lawyer know a lot of loophole that you don't know and some of them know the judge.

I rack up more than 20pts from speeding (just speeding) in my first 2 yr probation license.
I hire a lawyer and he takes care of it in a day. I still have to go to court with him.
I still keep my license but have to take high risk insurance. (SR-22 I think)

Good Luck and drive safely next time.
If you need to speed, use your head. At most 8mph over in hwy or 5 over in town.

You should contact a lawyer..

and stop blaming the stupid things you do on everything except yourself. You'll start using your head and making better decisions.

Firstly I think a attitude adjustment is needed in your case.
Now for the advice, I am sure that points only stay on your liceince for some amount of time and then they go away. Check and see if some points will go away in the next month or 2 and if that is the case get a atty and put it off as long as possible waiting for some points to go away before getting more.
