Yao sues Coca-Cola China over picture on bottles

Story Here

Now this isn't just another lawsuit from another greedy person. What's different and impressive is that all he wants is "an apology published in Chinese media and compensation of 1 yuan (12 cents) ..."

hmm that looks like a tough one, i think he might lose the case given the circumstances.

anyways, i didn't know that there is a chinese guys on the spurs...

The bottles show the Yao, San Antonio player Menk Bateer and Chinese player Guo Shiqiang in China's national team uniforms. Yao, the No. 1 draft pick in the NBA last year, and Bateer played for China last year in the Asian Games.

Coke says it has the right to show groups of at least three members of the Chinese national team under a sponsorship agreement.

``When the members are wearing the national team jerseys, they are not representing themselves, they are representing the team,'' Lee said from Shanghai. ``We just acted according to the legal right granted to us.''

I'm all for him not suing for money, but if they do have the rights to it then I don't see whats wrong

Seems to be a misunderstanding on both sides, esp cuz Yao is not suing for compensation.

Hmmm, I wonder if Yao is a US citizen now, or if he's just a legal alien. Could make all the difference.

IMO, this case comes down to whether or not the Chinese gov't has the right to sell the image of one of it's (former) citizens. If he's still a citizen of China, then there might be a problem since China is communist, but if Yao is no longer a Chinese citizen, his rights probably will prevail as Coca Cola is a US company and has to respect US laws first and foremost.

well, also, it's quite possible that yao had to sign something that released image rights (so long as he was in a chinese uniform), when he was on the olympic team.

everyone on any team of official capacity signs those... the point that'll be interesting is conflict of interest...

yao's interest, signed away to pepsi
vs.
china's interest, signed away to coke, to which technically yao ming might be bound (no idea to know without reading contract)

of course hes a chinese citizen, that is why he plays for the chinese national team. and this has nothing to do with china being commies or not, its a contract that the national team signed with coke. kinda like michael jordan had to wear reebok for the original dream team even though he has a contract with nike. also pepsi is a us company too, and yao just signed with them, i bet pepsi told him to sue coke just to piss them off, so who will prevail then?

yea... though i think the one that was inked first should win. if yao signed it later, then the pepsi contract is void since he promised something somebody else owned (the image in a chinese uniform).
