I bought Mario Kart Double Dash off of ebay for $25 shipped. the seller says the game disc is in mint condition and the case is in good condition. there is no manual, but this was mentioned in the auction.

below is a breakdown of his conditions:

New is brand new.
Mint looks brand new but is not sealed.
Near Mint is close to mint but just not quite perfect in some way.
Excellent would be extremely amazing condition with collectors quality.
Great is in almost perfect condition (maybe a few hairline scratches on the disc or a small crack in the case).
Good Condition is fully playable and not extremely cosmetically poor.
Fair Condition would be noticable light scratches (maybe cracks in case) or a worn manaul.
Poor condition would be just plain noticable damage.
Terrible may not work or is very bad looking.

the case matches his condition. the disc however, does not. it has tons of hairline scratches and is smudged all over. mint my ass. its more like fair to good condition.

I'm about to see if it works now (after i clean the smudges). i'm definitely emailing the seller to tell him i am not happy. if it plays ok, i may just ask for a partial refund and give him good feedback for doing so. if not, i'm returning it. should i leave good or neutral as long as he takes care of it? should I also ask for him to pay return shipping?

If he gives a partial refund, OR you return it for full pay in a timely manner, give him good feedback.

Glad it worked out.

I bought an N64 in "good" condition. The cables had been chewed through by some kind of rodent (possibly the seller) and the controller's analog stick was as limp as the seller's... auction description. It was DIRTY. And it came in a box that wasn't even sealed - I could reach in and pull stuff out without opening the box.

I was annoyed.

I see your point of view, but man, what are you expecting of a used game from ebay of all places... BTW. Why not buy it retail for $30... that way you don't have to worry...
