YAET: Who is responsible for the "misleading" item buys?

Ok, is the seller responsible because they are "misleading the buyer" or is the buyer for "bidding before reading?"

to you, who is responsible when

a. the auction states in unambiguous terms that the product is a box of a product and not the actual product itself.
b. the description states MULTIPLE times that the auction is for a box or a picture of a certain product.

inspired by the other ebay threads. just wanna gauge the consensus on here.
 
In that case the seller is responsible. That's just dirty business tatics. Any respectable seller would never do anything like that.
 
A. If the auction is in the items category, instead of it's correct category, and they try to purposely mislead. Then it's the seller's fault.
B. Buyer's fault.
 
The seller is misleading but that's not illegal. Ultimately it's the sellers fault for not reading carefully and now knowing what they are bidding on.
