YAET: Purchased item, misrepresented ( i think)

My brother (n00b that he is) purchased an XP 1800+ on ebay. We recieved what is shown in the pictures, and I feel that the item was misrepresented in the auction (mirrored at location below). Yes, I know the auction was shady, but i wasnt the one who did it.

Anyway, I emailed the guy to ask for a refund, stating that I expected a reatil box and a proof of purchase/reciept for warr purposes. I also said that I would not even open the proc package because it was inadequately shipped and I feared that it would not work.

The reply that I recieved was incoherent and threatening, stating that "he send it just like he got it" and "it has a warranty" (no specifics). He also said that "if you leave a negative feedback, it'll hurt you too." I frankly don't care, as its not my account and my brother uses it for buying anyway.

In any case, I'm trying to be reasonable, however this guy misrepresented the product at best and is a scam artist at worst. How would you suggest that I proceed?

It looks to simply be an OEM chip. I do not see anything to state that it is a retail chip he was selling.

I really don't see much of an option in getting your money back unless you can convince the guy to take it back.

You may want to email eBay and see what they say. I do not deal on eBay my self but a friend of mine does a lot of selling on it. Somewere around 50 plus items a day I believe, and he sometimes has to contact eBay about problems and they seem to help if possible.

The Pic of the retail box... Its a sketchy description. If I had to pick a side I'd take his though, your brother should have checked.
