YAET: Package has been lost. Seller did not buy DC, or anything.

Just wondering what I should do here:

10-12-04
Seller emailed me, and told me that package had been shipped.

10-19-04
I inquired about the package, and what the status of it was. Seller emailed me within 5 minutes asking for the item #. I gave it to him, and that was the last of communication by him until 10-28-04

10-20-04
Emailed him asking for a tracking number, anything.

10-23-04
Emailed him again, telling him that I paid $8 shipping for a pair of jeans, and the least I could get is some communication.

10-28-04 (today)
I waited a few days, crossing my fingers hoping it would show up. It did not. I went into one of the guys other auctions, sent him an email using the "ask seller a question" button, telling him to get back to me on the status of my shipment.

Here is the first email he sent me:

Hi Jason called the Ringle local post office today and spoke with Terry, (manager) gave her all the info. on the package she'll contact you by phone sorry for inconvenience with the services @ post office sometime please let know the status of package.

I got a call from my post office, and she said that there is nothing she can do about the package. She said he did not buy delivery confirmation, and she didn't know where it was. She suggested that I either wait a couple more days. (already as been 16 days) or I should request a refund.

I emailed him back, and told him what she had said, and requested a refund, and told him if the package comes, I will immediately paypal him the money back.

Here is the last email I just got back from him now:

we understand yours frustrastion unforturnately we cant refund yours fund until eithers of us receive the package its not our fault when the parcel post service got delay due to large volumn amount of packages we are not responsibility we were very disappointed this does not happen but sometime does happen package got lot & returns to sender if thats the case we glad send it out A.S.A.P please understand this is our policy & guideline please be patient. item shipped address under: (my address) parcel post service shipped on 10/12/04

What can I do now? Only thing I can think of is file a complaint with paypal. Anyone else have any ideas?
 
This has happened to me twice (as a seller). PO took over 3 weeks to deliver via Priority mail with DC. Still couldn't "track" the package. The first time I re-sent the item since it was a cheap thing. He got the second package, then got the first one three days later. This was only 150 miles away!


Give it a few more days.

How is his feedback?

 
What was the PO's excuse for taking 3 weeks to deliver via Priority Mail? Don't they advertise 2-3 day turnaround using that service?

It's not "guaranteed" 2-3 days.

I had a similar situation. Bought a GPS memory card and it took like 20+ days to get to my house (from Missouri to Virginia). Fortunately, I knew the seller personally so I knew he sent me the package so I just waited it out. Finally got the card one day on like the 30th of the month and the envelope was postmarked like the 6th of that month.

If the guy has good feedback and from the sounds of his E-mails, I would think he does quite a bit of business on Ebay, the package is probably lost in the mail somewhere. Bad luck but I would thinks could happen regardless if you sent it USPS, FedEx, DHL, UPS, etc

the liability has to be assigned somewhere if the parties don't agree otherwise. i forget exactly who the UCC assigns responsibility to, though. but there is a default liabilty rule.

The seller is responsible for any good delivered by mail. He paid for the package delivery service, they are acting as his agents and as a result it's all on the seller. The only situation that would change this is if the buyer arranged the shipping through a package pickup. The seller sent the package USPS parcel post, probably the most unreliable shipping method in existence (and didn't even shell out the dollar for package tracking) in the US and as a result is responsible for non-delivery.

The seller is using whatever shipping company to act as their agent. If the shipping company fails to deliver, then it is the seller's responsibility because they chose them to act on their behalf.

The buyer gets a refund from the seller, and the seller gets to yell at the shipping company. This works because in every case the person who gave money on the condition of goods/services rendered is yelling at the person/business responsible for not delivering on those goods/services that have already been paid for.

The buyer doesn't pay the shipping company, the seller does, and that is why it is their responsiblity when packages fail to show.
