I sold a phone to someone on Egay. He says that the little plastic piece that covers the IR sender is broke off. Which it wasnt when I shipped it. I am willing to replace the phone for him since its still under the manufacturers warranty, but he doesnt like that idea. In my auction I clearly stated that the only way a refund will be given is if the product is unusable upon delivery. I also dont want a negative (never had one before.)

So should I just tell this guy to keep what he bought, or give him his money back?
 
its only fifty bucks..but it would cost me another $8 to ship and $10 to do the exchange, which I am willing to absorb.

Thing is...I still have no proof that there is anything wrong with the phone.
 
Tell him that you can replace the phone, or you can let him keep it, but the phone is useable, so according to the terms of the auction, he's not entitled to a refund. If he gives you a negative, contact eBay.
 
I would state the terms of the sale, offer to take it back but he needs to pay the listing fees and shipping back to you. Now you are out no money and you are going over an above the terms of the sale to keep this guy happy. Get it fixed then sell it again.

Win Win situation! But he may not like the idea of paying shipping, too bad. You can always put your side of the negative.

thats what I am thinking too...I have been working with this guy for a week trying to make him happy....its not worth my time anymore
 
well he sent me an email threatening a negative feedback and also saying he was going to contact ebay...yada yada yada....

I emailed him back and very politely, but firmly told him to check the details of the auction again. I offered to refund him his money, minus ebay and paypal fees. He didnt like that thought. I guess he is just going to list it on ebay himself. Now we have to see what kind of feedback, if any, that he leaves
 
This is why, whenever you list something on ebay you add the statement "Buyer can choose to pay for insurance on shipping for their own protection. Failure to do so removes seller from any responsibility for defects in the product occurring from shipping." Or something to that extent, that way, if they pass on the insurance, (and it's likely that many will) you can tell them that it was their choice to pass, they took the risk, and something happened. If they are friendly and don't make lame threats, then you could be the nice guy and offer to help them in a way you think is reasonable. If they take the insurance, then they can claim that and there is no trouble at all.


I know it sounds under-handed, but there are plenty of people on ebay trying to screw you, and sometimes you have to think about yourself more than you do others, and the situation is right, help those who deserve it.
 
Tought crap for him, then. I would just say that you tried to be fair with him and it became apparent that anything that happend to the phone happened when it was out of your hands.
