anyway, i win, i pay via paypal. yesterday after 10 days buyer emails me, first contact with him, and he says, oh i made a mistake and he would like for me to just take my money back and he wants to relist it.

what's up with that?

He didn't get as much as he wanted for it and wants to re-list it to try to get more. To make this as painless a process for himself, he fvcked you about by not replying to you for 10 days in the hope that you'll be annoyed and not want it any more.

Tell him he's listed the item and you have bid on it, both of you have entered a legal contract and you will take matters further if he breaks his part of the contract.

that was basically my reply when he emailed me yesterday. i said, that's not my problem i paid, he held my money, i am not about to incur paypal fees because he was a moron and i want my item. he still hasn't replied.

 
Only give him a small break if he is a very new user who didn't know he could set a reserve and not possibly give the thing away. But I feel he should still honor this one.

he claims he meant to set the reserve at $40.00. so basically we are talking he will take a $30.00 loss or not even if you consider i was the only bidder and at $40.00 he would have had 0 bidders so more ebay fees etc.

he is an idiot all the way around. that really is one where he should just eat the loss.
 
Providing you didn't bid within about 30 seconds of it going up, he would have been able to adjust the auction (or even cancel/re-list) to include the reserve price if he realised he forgot to put it on.

He is legally contracted to sell you the item, if he fails to do so, he is breaking a contract that he agreed to by listing the item.

ya, i bid the last day. i believe the item was up for bid for the standard 7 days.

there really isn't much wiggle room. at this point his choices are limited. he can refund me and get negative feedback or he can eat the $30.00.

how do you "accidentally" set the reserve too low? Did he not review his auction before putting it up?

Screw him, you entered a contractual agreement and he's not backing out without your say-so.
