YAET: Justified negative eval? *update*

I purchased a Family Guy Season 3 DVD box set from a user using the "buy it now" price.

I paid via verified paypal immediatly, using instant payment service through Ebay.

I waited roughly a week and recieved no confirmation. So i emailed the seller on 1/12 (10 days after the purchase) and didn't get a reply.

So i emailed the seller a 2nd time on 1/14 (12 days after the purchase) and didn't get a reply.

I recieved a reply to the 1st email on 1/15 stating that it was on backorder with their supplier, and should be in soon to be shipped. He did not offer a refund.

I recieved a reply to the 2nd email on 1/17 stating that they had already answered my question.

On 1/20 (18 days after purchase) I got a shipping confirmation through their shipper saying "package shipped to you" and it gave me tracking via us mail. The package was not shipped at this time, tracking revealed that they had put it into the mail system just to give me a tracking number. Upon entering the tracking number i got a message saying that on 1/19 it was "expected to be shipped" but was in fact not picked up yet.

On 1/31 (29 days after purchase) The tracking updated to say the package was picked up and actually on the move to me. I still dont have it yet but expect it to be here Monday or Tuesday.

So in short: Took seller 29 days to ship, poor communication from seller, shady tactics so i wouldn't demand a refund by giving me a tracking number 11 days before shipment.

My question is, justified negative eval? or just a neutral?

*Edit* Just recieved today, it had aftermarket shrinkwrap and the dvds were obviously used before :|

Obviously being a buyer there isnt much i could do that would justify a negative eval.

EASILY justified!! Though wait till you get your positive, or the last hour or so before feedback expires.

well, not sure, but might have been botted evals...can't see a good seller doing that

I won't happen most of the times. They will leave it there.

In that case what is the time limit on evals? is there a way i can tell how much time is left? I want to negative this guy, but i only have 7-0-0 at ebay, and a negative would look horrible.

It actually does look that way, he has a bunch of repeat evals from people with 20 or less feedback. The username is jntsalespro.

man im hating ebay...i dont go there, but the last few people ive talked to that bought something it was out of stock....and they, too, had to wait quite a while to get it in. what a pain in the ass.

Looking further the idiot actually left himself feedback from a user named jntsales multiple times. I'm going to have to be more careful checking feedback from now on i guess.

agreed, im gonna wait until the time is almost up then leave a negative like 2 minutes before it expires.

Very unacceptable on the sellers part. This definately justifies a negative eval, as he was selling something he didn't even have. I'd A) Demand a NEW box set, instead of used, and B) Demand some sort of credit or discount on future purchases, or a refund of the shipping $$ you paid on top of the item. If he doesn't comply, i'd then leave negative feedback. See if he tries to correct the situation first.

People need to start leaving negs and neutrals for sellers who deserve them. You can bet this seller has done the exact same thing to other people who were too afraid to neg the seller. If they had done so, you might not have ended up in this position. Now you are also

So what if the seller leaves a retaliatory neg? Negs for a buyer are pretty much meaningless. The seller is the person who needs to worry about negs. Buyers worry too much about it. What does it even matter?
