YAET: Item not as described

Well I bought a touch screen monitor on ebay and it just wasn't as described. The seller said it was 19" when it was really 17". He also took two weeks before he even bothered shipping it out to me, didn't respond to emails, and I had to call him. Also it was considered new but open box, yet there were a ton of scratches on it. The question is who should pay for the return shipping?

Of course the seller should.

Or better yet the seller should be investigated for mail fraud.

Well turns out paypal agrees with the guy that I should have to pay shipping even though he listed the item incorrectly.
